Darmstadt Administrative Court
The Darmstadt Administrative Court was the administrative court in the Grand Duchy of Hesse or the People's State of Hesse with its seat in Darmstadt .
history
As part of the administrative reform, with the law “Concerning the internal administration and representation of the counties and provinces” of June 12, 1874, district and provincial committees were formed. The district committees consisted of the district council ( Landrat ) and six members elected by the district council. On the one hand, it was an administrative body, but also had the function of an administrative court for certain administrative matters. Appeals to the provincial committee were possible against decisions of the district committee . This consisted of the provincial director and other members elected by the provincial assembly.
The Darmstadt Administrative Court was set up as a court of appeal by law of January 11, 1875. The court, based in Darmstadt, was not responsible for all administrative matters. With the Administrative Justice Act of July 8, 1911, responsibilities were combined and expanded. Now the court was also responsible for the important area of police matters. The judges of the court were recruited on the one hand from experienced judges but also from experienced administrative experts.
In the Weimar Republic, Article 107 of the Weimar Constitution stipulated that each state had to set up an administrative court. Since this already existed in the People's State of Hesse, the Darmstadt Administrative Court continued its work. The DC circuit of Justice after the seizure of power by the National Socialists also affected the Administrative Court of Darmstadt. In addition, the administrative judiciary lost its function: A judicial review of administrative activities in the totalitarian state was not provided. Nevertheless, the Darmstadt Administrative Court initially continued to exist. In 1944 administrative jurisdiction was generally abolished.
With the Hessian law of October 31, 1946, the administrative jurisdiction in the newly created state of Hesse was reorganized. The Darmstadt Administrative Court was not re-established. The highest administrative court in Hesse became the Hessian Administrative Court , in Darmstadt the Darmstadt Administrative Court was established as the administrative court of first instance.
