Alfons Zschockelt

Alfons Zschockelt (born January 15, 1935 in Halle / Saale ) is a German lawyer ; as a judge he was a member of the Federal Court of Justice for 17 years . As a young man he also emerged as a jazz musician .

Zschockelt, whose parents both practiced as a lawyer and died early, grew up in Halle, where he already appeared as a young guitarist with his Alfred Zschokelt jazz band , which in 1950 played a “pioneering role” in the field of modern jazz in the GDR . Because of his origins, he was unable to study at first, but first had to take an exam as a professional musician. In 1954 he began his law studies in Halle, but continued to play jazz in various groups he led. With his Washboard Five he was supposed to represent the GDR at the World Youth Games in Moscow in 1957 and recorded two titles for Amiga . Together with Siegfried Schmidt-Joos , he fled to the West in autumn 1957. After fleeing, he completed his law studies in Düsseldorf in 1960 with the first state examination. Between 1959 and 1961 he belonged to the Feetwarmers , where he replaced Dieter Süverkrüp on guitar and banjo .

After the second state examination in 1965, he joined the judicial service of the state of North Rhine-Westphalia. In September 1968 he was appointed regional judge at the Cologne Regional Court. Between 1973 and 1976 he worked in the Ministry of Justice of North Rhine-Westphalia. Then he worked as a judge at the Düsseldorf Higher Regional Court.

Zschockelt was a member of the Federal Court of Justice between 1981 and 1998. After a short time in the 2nd criminal division , he was assigned to the 3rd criminal division of the Federal Court of Justice at the beginning of 1982 , which was primarily responsible for state security matters and between 1986 and 1990 also for criminal tax matters. In this Senate he also acted as permanent representative of the chairman since March 1991. Since 1990 he has also been a member of the Grand Senate for Criminal Matters and since 1991 of the Joint Senate of the highest federal courts . From the beginning of 1990 to the end of 1992 he was a member of the Presidium of the Federal Court of Justice; in July 1996 he was re-elected to this body. Since May 1990 he has also been a deputy member of the Presidential Council.

Zschockelt participated in numerous decisions of the 3rd Criminal Senate on fundamental questions of criminal law and criminal procedure law . In procedural law, he paid particular attention to the design of the right to apply for evidence and the agreements in criminal proceedings. He has significantly influenced the discussion of the Court of Justice on the abandonment of the legal figure of continued action . He also helped shape the development of case law in the field of narcotics criminal law .

Zschockelt wrote jurisprudential contributions on narcotics criminal law, on the agreements in criminal proceedings and on the abandonment of continued action. In addition, he commented on questions of legal policy and issued statements on various legislative proposals.
