Office Mockstadt

from Wikipedia, the free encyclopedia

The Mockstadt Office was an office of the County of Ysenburg-Büdingen-Büdingen , the Principality of Isenburg and subsequently in the Grand Duchy of Hesse .

function

In the early modern period , offices were a level between the municipalities and the sovereignty . The functions of administration and jurisdiction were not separated here. The office was headed by a bailiff who was appointed by the rulers.

history

In the Mockstadt office , the Solms land law had been in effect since 1578 , the common law only if the regulations of the Solms land law did not contain any provisions for a matter. The Solms land law remained in force when the office belonged to the Grand Duchy of Hesse in the 19th century. This legal situation was only replaced on January 1, 1900 by the civil code that was uniformly applicable throughout the German Empire .

The county of Ysenburg-Büdingen became part of the Principality of Isenburg during the time of the Confederation of the Rhine . The Mockstadt office also existed in the new state. At the Congress of Vienna (1815), the Principality of Isenburg itself lost its sovereignty and was mediated in favor of Austria . Austria passed on the area: On June 30, 1816, it signed a state treaty with Prussia and the Grand Duchy of Hesse, through which the Principality of Isenburg became a major part of the Grand Duchy of Hesse. This also included the Mockstadt Office . The Grand Duchy incorporated the Mockstadt office into its province of Upper Hesse . In all of these transactions, the ancestral rights of the Counts of Ysenburg-Büdingen in the office were preserved. Their rights as landlords enjoyed the protection of the Rhine Confederation Act of 1806. The office was thus one of the so-called "sovereign states " in the Grand Duchy of Hesse, as the princes of Isenburg-Büdingen continued to exercise sovereign rights in administration and jurisdiction in their ancestral territory .

From 1820 there were administrative reforms in the Grand Duchy of Hesse. From 1821 on, jurisdiction and administration were separated and all offices were dissolved at the lower level . District districts were created for the administrative tasks previously performed by the offices, and district courts for the first instance jurisdiction.

In the area of the Mockstadt office , the reform was carried out in 1822: The tasks that the Mockstadt office had previously performed in the administration were transferred to the newly formed district of Büdingen , the tasks that it had performed in the jurisdiction to the Büdingen district court . The Mockstadt office was dissolved.
