District court Gernsbach

The district court of Gernsbach is a court of ordinary jurisdiction and one of five district courts in the regional court district of Baden-Baden within the higher regional court district of Karlsruhe . The district of the district court of Gernsbach includes the communities of Forbach , Gernsbach , Loffenau and Weisenbach , located in the Baden-Württemberg district of Rastatt , with a total of around 24,000 inhabitants (as of 2018).

Headquarters and building

The district court is located in the city of Gernsbach in a two-story plastered building above the historic old town, almost on the tip of the Gernsbach city hump . The building that stood on the site before the city fire of 1798 had been used as an official cellar and upper office building. After it was rebuilt by master builder Abel in 1799, it served as a Catholic school. In the middle of the 19th century it was renewed and rededicated to the Baden district court. In 1872 Julius von Gemmingen-Steinegg , landlord on Watthalden near Ettlingen , bought the building for his then underage daughter St. Clair von Gemmingen-Steinegg . In 1873, however, the family gave up the management of the Watthalden estate and moved into the building in Gernsbach, from which the name Gemmingen'sches Haus comes from. Julius von Gemmingen-Steinegg ran a printing house for Christian writings there. Daughter St. Clair sold the building in 1919 a few years after her father's death, but retained the right to live in the attic until her death in 1951 . After it was used by the von Gemmingen-Steinegg family, the building became the seat of the local court again.

The only conference room contains a judge's desk made of fine tropical wood, on the equally clad wall behind it is the large state coat of arms of Baden-Württemberg, forged from iron . This design gives the conference room a rather unusual dignity for a small district court in rural areas.

tasks

The district court Gernsbach takes, with the following exceptions, despite its small size all tasks which according to the Law on Courts dedicated to the local courts. In civil law, only the dunning procedure is excluded, which in Baden-Württemberg is assigned to the Stuttgart District Court as the central dunning court and is processed there fully automatically. At the Gernsbach District Court, criminal justice is only practiced before the single judge (criminal judge or juvenile judge). If the lay judge has jurisdiction, the negotiations will take place at the Rastatt District Court .

The public prosecutor's office responsible for the entire judicial district is located in Baden-Baden.

As part of a land registry and notary reform, the notaries' offices based at the Gernsbach District Court were dissolved on January 1, 2018.

particularities

The Gernsbach District Court is one of the - meanwhile few - German district courts where the director is the only judge. He has to lead all the proceedings that are assigned to the local court - that is, civil litigation of all kinds, as well as criminal cases as an individual or juvenile judge.
