Bernd Schmalhausen

Bernd Schmalhausen (born June 10, 1949 in Dorsten ) is a German lawyer and judicial historian.

Life

Schmalhausen grew up in a middle-class family in the north of Essen . After studying law at the University of Münster , he received his doctorate there in 1980 and from then on worked as a public prosecutor in Essen. Visits to Israel made him aware of the deficits in dealing with the past in the Federal Republic of Germany. He made friends with the Israeli Baruch Bar Din (* 1924), the son of the former Essen District Court Director Hermann Ferse (1881-1942), who was released in 1935 and deported from Essen to Minsk to the Minsk ghetto in 1941 and murdered in the Maly Trostinez extermination camp . The son was rescued in 1939 on a Kindertransport to Palestine . An award that Berthold Beitz received at Yad Vashem was the reason for Schmalhausen to write a biographical study on Beitz's resistance to National Socialism . His next book was about Max Liebermann and his wife Martha , who was driven to suicide in 1943 . Another with the emigrant and later North Rhine-Westphalian Minister of Justice Josef Neuberger .

As a result of its own archive research, Schmalhausen has presented a small volume on the fate of Jewish lawyers in Essen during the National Socialist era . In the mid-1990s, he ensured that, against the hesitant resistance of the then regional court president Gero Debusmann, the large-format oil painting of the National Socialist regional court president Paul Heermann , who headed the Essen regional court from 1933 to 1945 and thus also supervised the associated hereditary health court and the special court , and who was responsible for the harassment of Essen's Jewish lawyers and the death sentences passed in his court , was removed from the ancestral gallery in the courthouse. He was one of the few initiators who, against the passivity and disinterest of his colleagues, ensured that a commemorative plaque was installed in the Essen regional court in 1996 for the twelve Jewish lawyers who were expelled from the Essen judiciary and some of whom were murdered. With the appointment of the President of the Regional Court, Monika Anders, there was a change in the management of the Regional Court in the treatment of such past and present questions. On his initiative, the city of Essen wants to remember the 280 fellow citizens murdered there in the memorial in Maly Trostinez with a plaque after it was initially rejected by local politicians because it seemed aloof to them.

Schmalhausen is a volunteer football fan in his home club Rot-Weiss Essen .
