Bios was the name of a by fermentation of malt brewed soft drink . The non-alcoholic organic lemonade was offered in the flavors elderberry-grape, red apple, lemon grass, orange-ginger and " coola ".

The organic soft drinks were presented in 2008 at the BIOFACH trade fair . At the beginning of 2012, a Germany-wide distribution was created in cooperation with the Paulaner brewery , after the drink had previously only been sold in northern Germany . Production was stopped in 2014; As you can read on the company's website, they were working on a repositioning. BIOS GmbH was merged with another subsidiary of the Nordmann group in 2015 and then dissolved.

Manufacturing

The manufacturer of the fermented beverage was “Landwert Bio Premium GmbH”, a subsidiary of the Nordmann group of companies , which is also the owner of the Störtebeker brewery .

Bios was made without the addition of granulated sugar; the sweetness was achieved through the addition of organic fruit juices, which naturally contain fructose, and the fermented organic malt. No acid regulators were added either. As the first fermented soft drink, Bios used certified organic flavors that came from the eponymous organic fruit.

According to the law, Bios had a low physiological calorific value of approx. 84  kJ / 100 g (20  kcal / 100 g) and, apart from the drinking water content, consisted of 100 percent organic raw materials.

Legal dispute with Bionade GmbH

On May 5, 2008, the Stralsund brewery obtained an injunction before the Düsseldorf Regional Court (Az .: 37 O 74/08), according to which the fermented soft drink Bionade may no longer be advertised as being rich in calcium and magnesium because Bionade does not show the minimum quantities of it and therefore advertising is not permitted.

The Lower Franconian manufacturer of the Bionade, which has been on offer since 1995, had already applied to the Bios manufacturer in March 2008 before the Hamburg Regional Court :

  • to refrain from advertising with references to the production process of Bios without added sugar,
  • to forbid the claim "No added sugar" in all organic products,
  • to ban the statement "the first fermented soft drink that really consists of 100% organic raw materials",
  • to prohibit the comparative representation with a Bios bottle with no added sugar, a Bionade bottle with five displayed sugar lumps and a Coke bottle with 12 displayed sugar lumps under the heading "Sugar content in comparison",
  • to prohibit the manufacturer's information on the labels without a detailed address,
  • to ban the claim of Bios as "thirst-quenching than the market leader".

The Hamburg Regional Court decided that Bios may continue to be advertised with the words “No added sugar” and “the first fermented soft drink that really consists of 100% organic raw materials”. The heading "Sugar content in comparison" and the statement "Thirst quenching than the market leader" may no longer be used, the address must be given.

The Hamburg Regional Court also ruled that Bios should not be sold with the claim "good for the body" and that the slogan "more thirst-quenching than the market leader" should not be used, as this represents an inadmissible form of comparative advertising and is therefore unfair within the meaning of the law Provisions.

According to the court, the organic soft drinks are an innovative further development and not an imitation product.

In December 2008, the Bionade GmbH and the Nordmann Group reached a settlement, according to which all legal proceedings will be terminated. It makes no sense that the only organic drinks actually produced by very expensive fermentation are covered in processes, explained Peter Kowalsky , Managing Director of Bionade GmbH. He also confirmed that Bios does not imitate the Bionade. Oliver Nordmann, a partner in the Nordmann group of companies and bios initiator, however, recognized the pioneering work and entrepreneurial achievement of Bionade GmbH in the invention and establishment of a completely new product group.

rating

In 2008, the German consumer magazine Ökotest rated the variant “Bios Orange-Ginger” with the rating “very good”, because “(...) Bios, unlike Bionade, does not contain granulated sugar or acidity regulators”. In addition, Bios is consistently flavored with organic flavors and the taste is convincing. The assessment was confirmed in 2009.
