Structure of the umbrella organization

The umbrella organization of social insurance agencies is the umbrella organization for statutory health, accident and pension insurance in Austria. He represents and coordinates the interests and activities of the five Austrian social insurance agencies:


The umbrella association of social insurance agencies was legally established in 1948 as the main association of social insurance agencies , later the main association of Austrian social insurance agencies and has been using the current name since January 1, 2020.

Tasks and legal basis

The umbrella organization is set up by the General Social Insurance Act (ASVG), which also defines its most important tasks.

The umbrella organization plays a central role in:

  • the performance of cross-agency administrative tasks in the field of social insurance,
  • the resolution of guidelines to promote the expediency and uniformity of the enforcement practice of the social insurance institutions and
  • the coordination of the enforcement activities of the social security agencies.

General association duties

The tasks of the umbrella organization for the individual insurance carriers include

  • the management of a common EDP system (since 1972) and management of those databases that are jointly important for the social insurance institutions (central partner management ZPV)
  • Management of an electronic signature-enabled management system, of which the e-card is a component
  • According to § 30c Paragraph 1 Z 8 ASVG, §§ 31a ff. ASVG (electronic administration system - ELSY), the issuing of the e-card is one of the main tasks. It is a key card for numerous applications in the health system and as a European health insurance card (EHIC) for access to health systems in the EU and equivalent countries of the European economic area
  • Forwarding of registration and accounting data ("data hub main association") for social insurance carriers, hospitals, contractual partners, employers, labor market service ; Assignment of social security numbers ; Information to courts and authorities based on legal requirements such as B. participation in censuses
  • the conclusion of the overall contracts for the social insurance institutions with the respective professional bodies on medical treatment, mother-child pass benefits, occupational medicine, preventive medical check-ups, supply of therapeutic products, psychotherapy, etc.
  • The issuance of a social security reimbursement code for the dispensing of medicinal specialties on account of a social security institution in the established area. See Section 30b, Paragraph 1, Item 4 of the ASVG.

  • Negotiation of collective agreements for employees and workers, doctors and dentists in institutions of the social insurance institutions. Around 27,000 people work in Austria on the basis of three service regulations and the collective pension agreement.
  • According to Section 30c, Paragraph 1, Item 5 of the ASVG, the umbrella association of social insurance agencies is also responsible for the publication of the Social Security magazine . It has been published since 1948 and can also be viewed electronically in the National Library .

organization

The umbrella organization is a legal person under public law. It is run according to the principle “by the insured for the insured” in self-administration by insurance representatives. This form of organization is based on Art. 120a of the Austrian Federal Constitutional Act . Bodies, the so-called self-governing bodies, are formed from among the members of the community of insured persons.

The umbrella organization has two self-governing bodies:

  • an executive body: the Conference of Social Security Institutions
  • a controlling body: the general meeting of the social security agencies

The conference of social security agencies

The conference of social security agencies consists of ten members:

  • the chairmen of the five social security agencies and
  • the respective deputies of the chairmen or women.

The ten members of the conference elect two chairpersons from among their number, who take turns in chairing each for six months. In the current term of office (January 1, 2020 to December 31, 2024) this is alternating

  • Peter Lehner (chairman of SVS) for the first half of the year and
  • Ingrid Reischl for the second half of the year (deputy chairman of AUVA).

The conference of social insurance agencies represents the umbrella organization externally. It fulfills all tasks that are not expressly assigned to the general meeting (general competence). This includes u. a.

  • the resolution of the statutes of the umbrella association,
  • the resolution of the model statutes for the sponsors,
  • the adoption of guidelines that apply to all social security institutions,
  • the decision of binding goals (strategic, operational and financial) and the review of the implementation and
  • the preparation of the annual budget, which will be presented to the general meeting for final resolution.

She also decides on projects, awards contracts and makes personnel decisions. The conference usually meets once a month.

The general meeting of social security agencies

The general assembly is the controlling body of the umbrella organization and consists of 21 members.

Are members of the general assembly

  • the presiding chairpersons on the administrative boards of the social security agencies and
  • the chairmen and their deputies of the general assemblies of the social security agencies.

Persons belonging to these groups have a voting right in the general meeting.

Members of the general assembly are also

  • three representatives of senior citizens' associations and
  • three representatives of the disability organizations.

Members of these groups have no voting rights in the general meeting.

The chairmen of the general assembly come from the same institution as the chairmen of the conference of social insurance institutions. In the current term of office, therefore, the chairman of the general meeting and his deputy are sent from the SVS in the first half of the year and from the AUVA in the second half of the year.

The general meeting has three important tasks:

  • It adopts the annual budget presented by the conference.
  • It elects the sworn auditors to examine the financial statements and approves them.
  • It relieves them of the conference.

The general meeting meets at least twice a year.

Principle of self-management

The aim of self-administration is to organize the provision of services by the affected groups of people themselves within a legal framework. Since the groups of people benefit from the services, pay for them themselves and thus the tasks are in the exclusive or predominant interest of the insured community, they also have a great interest in the sensible and economical use of the available funds.

In a self-administered system, the federal government therefore delegates tasks that it could in principle also carry out itself to organizations created by law, such as the social insurance agencies and the umbrella association of social insurance agencies.

The insurance representatives, i.e. the members of the self-governing bodies of the social insurance institutions and the umbrella organization, are sent by the employee representatives and employers. The democratic legitimation of self-government is guaranteed by sending members based on election results in the chambers (chambers of labor, chambers of commerce and chambers of agriculture). The term of office of the self-governing bodies of the social insurance agencies and the umbrella association is five years each (currently from 01/01/2020 to 31/12/2024).

Within their own sphere of activity, the social security agencies and the umbrella organization can carry out their legally stipulated tasks without instructions from state administrative bodies.

If the social insurance agencies or the umbrella organization of social insurance agencies take on agendas and activities in the transferred sphere of activity for other institutions (e.g. the federal government), they are, however, subject to a right of instruction by the competent state authority (e.g. indirect federal administration ).

At sight

The constitution also provides for a federal supervisory right over self-governing organizations. The supervisory authorities are the Federal Ministry of Social Affairs, Health, Care and Consumer Protection and the Federal Ministry of Finance .

Office management

The office of the umbrella association is run by an office manager and his deputy. The conference of the social security agencies entrusts the two of them with the day-to-day management. Both are appointed for a period of four years and are bound by instructions from the Conference of Social Insurance Institutions. Currently (July 1, 2019 to June 30, 2023) Martin Brunninger is appointed as office manager and Alexander Burz is appointed as deputy office manager.

You take u. a. perform the following tasks:

  • Ongoing administrative transactions, provided that in individual cases one and a half times the threshold value set for the respective year for services in accordance with Section 12 (1) No. 1 BVerG 2018 is not exceeded (in 2020: EUR 216,000)
  • Personnel matters, unless they are handled directly by the conference
  • the initiation and enforcement of proceedings before courts and administrative authorities as well as the exercise of party status, with the exception of proceedings before the Constitutional Court
  • the submission of opinions in the review process
  • Representation of the umbrella organization externally in matters that do not require the decision of the conference or the general assembly
  • the granting of subscription and disposal authorizations in banking transactions in agreement with the chairman of the conference for amounts that have already been released
  • the placing of orders for the inspection activities of the internal audit as well as the approval of the inspection plans
  • the replenishment of objects and materials that are necessary to maintain continuous operations
  • the award of necessary recurring orders to ensure smooth operations and to maintain operational security
  • Changes to the reimbursement code and agreement on drug prices
  • Money and capital market dispositions to manage the financial management of the umbrella association and the funds to be managed by it in agreement with the chairman of the conference and his / her deputy.

founding

The umbrella organization in its current form was created through the Social Insurance Organization Act SV-OG , with which the reorganization of the social insurance institutions and its umbrella organization was decided on January 1, 2020. The predecessor organization of the umbrella association of social insurance agencies was that of the main association of Austrian social insurance agencies. In 2020 there was a far-reaching organizational change and a change of name, but the legal entity (according to the legal materials, "institutional infrastructure") remained the same, so all legal relationships automatically continued to exist for the time being.

The office building of the umbrella association is located at Kundmanngasse 21 in Vienna's third district. It was reopened in 2019 after a general renovation. The architects Chaix & Morel et associeés from Paris emerged as the winner from the 65 projects submitted in the competition. The building was given a light facade, which also better takes into account the Wittgenstein House to the north of it.

Publications

The umbrella association of social insurance agencies has the legal mandate to publish the specialist journal " Social Security ". The vintages of this magazine from its inception in 1948 are on offer to the Austrian National Library on the Internet available, the younger expenditures on the homepage of the Federation and in the magazine collection of the legal database of the Manz publishing house (from 1978).

Legal regulations that are issued by the umbrella organization, including their changes, are published in their binding version on the Internet. The announcements can be found in the documentation of the Austrian social security law SozDok as well as at ris.bka.gv.at on the Internet in their current version (also in earlier versions).

The general contracts that the umbrella association of social insurance institutions concludes with interest groups (chambers) of doctors, dentists, pharmacists, midwives, psychologists, opticians, bandage artists, medical institutes, hospitals and other health professions are also published on the Internet.
