The Hohe Buchene Forest in the Ebracher Forest was a protected part of the landscape in the Steigerwald , northwest of Ebrach and with 775 hectares the third largest forest reserve in Bavaria. Some rare animal and plant species can be found in the very unspoilt forest area, such as the hedgehog goatee . The area is predominantly overgrown with beeches , some of which are 300 years old. Because of this, on December 20, 2010, the district council of the Bamberg district decided with a very large majority to take all necessary measures to have these forests recognized as world natural heritage . Shortly before the end of the electoral period on April 16, 2014, the then Bamberg District Administrator Günther Denzler designated the Hohe Buchene Forest in the Ebracher Forest as a protected area against strong opposition in the Bavarian state government .

The protected area covered a substantial part of the area of ​​the community-free area Ebracher Forst . Around half were accounted for by process protection zones in which natural forest development had priority, the other half for development zones in which forest development was to be managed in a forestry way towards natural deciduous forest communities typical of the location. The adjacent nature reserves of the Waldhaus and Brunnstube nature forest reserves with a size of 105 and 48 hectares, respectively , were not included in the protected area .

The designation of the protected area was controversial in the region. Proponents saw in it a first step towards a " National Park Steigerwald" with the long-term goal of recognition as a world natural heritage . Critics pointed to the impact on forestry . In addition, they doubted whether the definition of such a large protected landscape component corresponds to the intention of § 29 BNatSchG.

According to a communication from the government of Upper Franconia on August 12, 2015, the protected area should be abolished on September 1, 2015 because it is not part of the landscape within the meaning of the Bavarian Nature Conservation Act; the Bund Naturschutz in Bayern and the Landesbund für Vogelschutz in Bayern announced that they would take legal action against this.

The controversial protected area was then actually withdrawn by regulation in September 2015 due to illegality. This “illegality” was also established by the government of Upper Franconia. This is why the ordinance was repealed on September 1, 2015. According to the legal opinion of the government of Upper Franconia, "the ordinance of the Bamberg district office on the protected landscape component of the high beech forest in the Ebracher forest of April 16, 2014 is illegal, since the ordinance is not covered by the authorization basis of § 29 BNatSchG." The government of Upper Franconia also writes that "the Hohe Buchene Forest is not a suitable subject of protection for a protected part of the landscape". According to the government, it is “not an object lifted out of the landscape, as the law requires. Therefore, the regulation had to be repealed for reasons of the rule of law and also in the interests of legal clarity and certainty. "

The Bavarian Administrative Court has declared the abolition of the forest protection area to be legal. The Federation of Nature Conservation in Bavaria and the State Federation for Bird Protection announced an appeal against this decision at the Federal Administrative Court.
