The German Association for Public and Private Welfare e. V. ( German Association for short ), based in Berlin (formerly Frankfurt am Main ), is the association of, among other things, public and independent social work providers . It is a registered association that is recognized as a non-profit organization. The association has more than 2,500 members, including districts, cities and municipalities as well as their central associations and the central associations of the independent welfare as well as federal ministries and authorities, state administrations, supra- local social welfare agencies, universities and technical colleges, associations, social institutions, training centers, individuals and Social economy company. It was founded in 1880. According to its current statutes, it promotes efforts in the field of social work , in particular social assistance , youth welfare , health care and poor relief in the Federal Republic of Germany. Practical social work is not the task of the association, but that of its members.

The President is currently the District Administrator Johannes Fuchs. His predecessor in office is Wilhelm Schmidt . Michael Löher is the director.

history

The organization was founded in a founding meeting on November 26th and 27th, 1880 as the "German Association for Poor Care and Charity". 1897 of appeared Paul Felisch on behalf of the DV authored work The caring for left school youth . In the work Felisch calls for the introduction of a youth law. During the Weimar Republic , the association became a professional interest group that had a major influence on welfare legislation. During the time of National Socialism of DV has been brought into line and so escaped his resolution. After 1945, the rebuilding took place under Wilhelm Polligkeit .

The purpose of the association is:

The association is a coordination point for all efforts and developments in the areas of social, child, youth and family policy as well as social and youth welfare, elderly and health care, rehabilitation and handicapped care, care, social professions and international social work. In order to support its international work, the German Association cooperates with international and European organizations. Among other things, he is a member of the International Council for Social Welfare (ICSW).

Editing and specialist dictionary

The association publishes numerous materials, including a. own book series, the journals News Service (NDV) and Jurisprudence Service (NDV-RD) as well as the archive for science and practice of social work of the German Association. In addition to the German Welfare Day , which takes place every three years , it organizes the major social congress in Germany, specialist conferences, workshops and numerous further training courses for people involved in social work.

On the occasion of the 100th anniversary in 1980, the first edition of the specialist lexicon of social work was published . In 2017, the 8th, completely revised and updated edition of the specialist lexicon was published.

financing

The association is financed almost exclusively from funds from the Federal Ministry of Family Affairs. Since 2002, it has been funded on the basis of a funding agreement with the Federal Ministry for Family, Seniors, Women and Youth. The funding amount is capped at 4,455,000 euros. Only 550,964.50 euros were raised in the 2011 financial year through state subsidies, membership fees and donations. The German Association recorded its own income in the 2011 financial year in the amount of € 908,590.06. The association organizes a wide range of specialist conferences on topics from the field of welfare. The German Association receives a flat-rate grant of 36.00 euros per participant per day and a flat-rate grant of 256.00 euros for external speakers for each “of the central federal specialist events in the federal interest”. The “federal interest” is specified by the Federal Ministry for Family, Seniors, Women and Youth, which is also the main donor of the German Association.

Recommendations and opinions

The association develops recommendations and statements on many social law issues. More recent examples are the "Statement of the German Association on the Government Draft of a Law to Improve Child Protection " and the review of the need for long-term care from March 2009 or the recommendations for needs assessment and help planning in integration assistance for people with disabilities from June 2009.

An example of how the work of the association works in practice are the recommendations on the granting of sickness allowances in social assistance from October 2008, which replace the previous recommendations from 1997.

Also since October 2008, the Presidium has passed recommendations on full-time care for children and adolescents, in which it recommends adjusting the maintenance payments of the youth welfare offices to children and adolescents in foster families for the respective following year in accordance with Sections 33, 39 of Book VII of the Social Code.

In October 2009, the association published recommendations on the compatibility of family and work life .

One example of the association's European policy work are the “Recommendations of the German Association on the social design of the so-called post-Lisbon strategy from 2011”.

criticism

Health allowances

In 2008, the association issued new “Recommendations on the Granting of Health Care Allowances in Social Assistance”, which replace the previous recommendations from 1997 and which were sometimes controversial. They are based on the "Rationalization Scheme 2004" of the Federal Association of German Nutritionists and other professional associations as well as a scientific study by the German Nutrition Society .

On this basis, the recommendations come to the conclusion that with diabetes, elevated fat levels and other common diseases, according to the current state of science, no diet is required and a healthy diet is sufficient. For this reason, additional financial contributions are not required. Since the need to adhere to a certain diet was no longer given, the statutory requirements for granting health food allowances were missing. The costs for a healthy diet are to be covered with the normal standard rate, "if the economy is managed extremely sparingly." B. Celiac disease , an additional need is still affirmed.

The association emphasizes that it has expressly made no statement as to whether the standard rates as such are appropriate and that it has only commented on a clearly defined issue.

The core content of the recommendations was adopted by the Federal Employment Agency in their “technical information” on Section 21 (5) SGB II. The case law follows the recommendations.

Rule set

Recently, the association has u. a. submitted an opinion to the Federal Constitutional Court on the level of the standard rates of basic security benefits. In its judgment of February 9, 2010, with which the Federal Constitutional Court declared the level of the standard rates of unemployment benefit II ("Hartz IV") partially unconstitutional, the association is quoted repeatedly. The determination of these standard rates was largely based on surveys and calculations by the association. In it the court states:

“The German Association for Public and Private Welfare points out that the assessment of a welfare benefit to secure a livelihood is so closely linked to political views and evaluations that the constitution itself can hardly provide a specific benchmark. He is of the opinion that the sample of income and expenditure is a suitable basis for measuring welfare state minimum benefits. The statistical model of the Standard Rate Ordinance 2005 is based on the consumption behavior of the lowest income group without social assistance recipients. By excluding beneficiaries from this group, there is a suitable basis for the standard rate assessment. In the further development of the statistical model, care should be taken to ensure that requirements are not underestimated and that an appropriate update factor is found. "

Nevertheless, as evidenced by the ruling, the association had nothing to complain about the fact that significant parts of the standard rates and especially those for children had been set without taking into account or even disregarding the results of the association's surveys and calculations. The Federal Constitutional Court has criticized this fact and asked the legislature to change it.
