ENP So that
ENP Sowah was the Chief Justice of Ghana between 1986 and 1990 , i.e. the highest judge. Sowah was named the seventh Chief Justice since the country's independence during the military dictatorship of the Provisional National Defense Council (PNDC), led by Jerry Rawlings . Fred Kwasi Apaloo's predecessor in office, Sowah's successor in office was Philip Edward Archer .
Sowah had already reached the specified seniority as a judge at the Supreme Court in 1986 and was due to retire from the judge's office. In 1986 the PNDC passed a law (Judicary Retiring Ages Law, 1986, PNDCL 161) that allowed judges to voluntarily exceed the age limit for judges with the approval of the PNDC. The duration of exceeding the age limit for judges was also at the discretion of the PNDC.
Sowah made use of this option and stayed in office for another four years. This move was heavily attacked by the Ghanaian Bar Association as well as by the judges. Here the independence of the judge's office was essentially called into question.
