Railway Authority

Railway authorities are state organs that either form the administrative body of a state railway company or supervise a private or state railway company. A distinction is made between railway administration and railway supervisory authorities. The administrative authorities of the state railways also have supervisory powers.

Germany

In Germany is at a score of 2013 after the General Railway Act (AEG) , the Federal Railway Authority (EBA) the competent railway supervisory authority, in §§ 5 and 5a the jurisdiction and "duties and powers of the railway supervisory authorities" are defined.

Austria

In Austria , the supervisory authority responsible for railway matters as of 2020 is the Supreme Railway Authority , Dept. IV / E in the Federal Ministry for Climate Protection, Environment, Energy, Mobility, Innovation and Technology . In the Austrian Railway Act (EisbG) , part 2, Sections 11–13b, explains the “responsibilities and duties of the railway authorities”.

Japan

In Japan there was the Ministry of Railways . It was responsible for the operation of the state railways in the Japanese Empire .

Luxembourg

In Luxembourg , the National Safety Authority within the meaning of Directive 2004/49 / EC and the law of July 22, 2009 is the Administration des Chemins de Fer .

The regulatory body within the meaning of Directive 2012/34 / EU and the law of 6 June 2019 is the Institut Luxembourgeois de Régulation .

United States

In the United States , the federal railroad administration is the regulatory authority for railroad matters .

According to the state of 1911/1912 were in the German State Railway Authority as a regulatory body, the Reich Railway Authority ; the state railway administration authorities in the individual states usually have one (general) or several directorates

In Prussia the railway authorities were the directorates subordinate to the Ministry of Public Works ; among them the factory, machine, telegraph and traffic inspections.

In addition, state supervisory law was exercised

  • in Prussia for the private railways in the lower instance by the presidents of the Royal Railway Directorates;
  • in Bavaria by the Ministry of the Royal House and Foreign Affairs, for the private railways in the first instance by the district governments;
  • in Württemberg from the Ministry of Foreign Affairs, for the private railways in the first instance from the General Directorate of the State Railways;
  • in Saxony from the Ministry of the Interior for tariff and timetable systems and otherwise from the Ministry of Finance, for private railways also through special commissions (district or official governors, or technically trained state railway officials);
  • in Baden and Hesse from the Ministry of Finance, re. by special commissioners,
  • and in Alsace-Lorraine for the private railways from Department IV. of the Ministry for Alsace-Lorraine, while the highest state view of the Imperial Railways in Alsace-Lorraine is exercised by their highest administrative authority, the Imperial Office for the Administration of the Imperial Railways.

In a similar way, the other aforementioned state supervisory authorities are also entrusted with the ultimate management of the administration of the state railways in the respective countries.
