The European EDV Academy of Law (EEAR) was a legal research and training institution based in Saarbrücken . The shareholders were the Saarland and the German EDV Court Day .

history

When looking for a location for the academy, the EDV court day had several offers, including one from the city of Goslar . The decision to locate the academy in Merzig was made in June 2005. The decisive factor was the proximity to the cities of Saarbrücken ( University of Saarland ), Trier ( University of Trier , German Judges Academy ), Wadern ( International Meeting and Research Center for Computer Science ) and Luxembourg ( University of Luxembourg ). The EEAR was housed in the former nurses' home in Merziger Fellenbergpark. Five seminar rooms and two office rooms were available there on around 350 square meters. The opening ceremony took place on April 24, 2006. Due to the proximity to Saarland University, the company headquarters was relocated to Saarbrücken in 2015.

The articles of association were signed on November 8, 2005 by the Saarland Minister of Science Jürgen Schreier and the chairman of the EDP court conference , Maximilian Herberger . The share capital of the non-profit GmbH amounted to 210,000 euros, of which the Saarland contributed 150,000 euros and the IT court day 60,000 euros.

As part of the Germany - Land of Ideas initiative , the EEAR was presented on April 22, 2007 as the location of the day .

The company has ceased business operations and was liquidated in June 2018.

According to the articles of association, the EEAR dealt with the “feasibility and consequences of electronic information processing in law and administration” and was intended to promote science and research, “in particular by promoting the use of information technology in the legal system and administration”. To this end, the academy offered seminars and workshops in which the participants were familiarized with, for example, Internet law ( e.g. electronic legal transactions , XJustiz or electronic signature ) and other areas of IT law ( e.g. data protection or computer crime ). For interpreters and translators, a seminar on German civil and criminal law was offered together with the Federal Association of Interpreters and Translators .

Creative Commons

In February 2007 the EEAR became a cooperation partner of Creative Commons . As project lead , the academy and the Saarbrücken Institute for Legal Informatics were responsible for adapting the licenses to the German legal situation. A German version of the 3.0 licenses was recently developed.

In addition, the academy accompanied the development of IT solutions for the legal system, for example a pilot project for the use of speech recognition at Hessian social courts , and held specialist conferences such as the annual Merzig database forum law. On behalf of the Conference of Ministers of Education and Cultural Affairs , the EEAR has been responsible for the collection under university law since 2006 , which is now being continued as a freely accessible online database.

In May 2007 the EEAR set up the Central Register of Protective Scripts, in which protective scripts could be deposited, which could then be called up by the courts. Particularly in the case of a "flying jurisdiction" , the submitter should be given the opportunity to store their protective letters in a central location. The administrative workload for the courts has also been reduced. In July 2007 the Saarbrücken , Mannheim and Bremen regional courts were won over as partners for the pilot project. In the meantime, 45 regional courts and 17 local courts carried out an electronic query in the register upon receipt of an application for an interim injunction. In accordance with Section 945a of the German Code of Civil Procedure , which came into force on January 1, 2016 , the State Justice Administration of Hesse maintains a central, transnational electronic register for protective writings (protective writings register) for the federal states. Until a nationwide supply of the lawyers with signature cards and thus a comprehensive use of the new register was guaranteed, the EEAR continued to offer its protective letters register in coordination with the justice administration in parallel operation in addition to the protective letters register according to § 945a ZPO. On November 30, 2016, this original form of the protective script register was finally discontinued.
