The European Law Institute (ELI) is a non-profit organization that was founded on the model of the American Law Institute (ALI) and, similar to the ALI, consists of both Fellows (individual members) and observers (Individual or Institutional Observers) . In addition to numerous international organizations, courts and professional bodies, members of the ELI are primarily European and international lawyers from various fields and professions from practice and research.

History of origin

In the past ten years there have been calls for a permanent private legal institution to support the development of European law, particularly in literature. The establishment of a European counterpart to the American Law Institute was called for.

In 2010, it was possible to merge various initiatives such as the European University Institute (EUI) and the Association for a European Law Institute (ELIA) into a single, comprehensive initiative.

As a result, the ELI was founded on June 1, 2011 in Paris. Since then , the association's headquarters have been in Brussels , the secretariat and its staff are in Vienna . The latter was opened on November 17, 2011 as part of a ceremony at the University of Vienna . Viviane Reding , Vice-President and Commissioner for Justice, took part in this event for the European Commission and gave the opening speech. On March 26, 2012, the ELI was presented by the President and other members of the Committee on Legal Affairs and the Internal Market of the European Parliament .

organs

Christiane Wendehorst has been President of the ELI since September 2017 . She succeeds Diana Wallis , formerly Vice-President of the European Parliament. The former Advocate General at the Court of Justice of the European Communities , Francis Geoffrey Jacobs , was the first ELI President . Members of the Senate include the former President of the Austrian Supreme Court Irmgard Griss and the Director of the Max Planck Institute for Comparative and International Private Law , Reinhard Zimmermann . The Council , the main decision-making body of the ELI, currently has around 60 elected members. Among them is the Lord Chief Justice of England and Wales John Thomas. In total, the general assembly of all members currently has more than 950 people. New members have to face a selection process based on certain criteria.

Hubs and Special Interest Groups (SIGs)

There are currently 10 national hubs across Europe. These serve to simplify communication both between the members and to the outside world and to facilitate the acquisition of further members.

There is currently an Austrian, Croatian, French, German, Irish, Italian, Polish, Slovenian, Spanish and British hub. Further hubs are currently being planned. There are also 11 working groups that focus on special areas of law, including administrative law, financial law, EU law or civil law, so-called special interest groups.

Projects

The European Law Institute aims to contribute scientifically and practically to the development of law in Europe in the broadest sense. Current information about projects and activities of the institute can be found in the News section of the ELI website and in the monthly newsletters published there. The projects pursued either have a short duration ( statements ) or are designed to run for several years ( instruments ). The selection, support and acceptance of new projects is based on the so-called ELI Project Guidelines. The projects already completed by the various ELI working groups include a statement on the European Commission's proposal for a Common European Sales Law , a statement on the excessive workload at the European Court of Human Rights . and a statement in the field of European copyright law, which was submitted to the European Commission as part of a public consultation.
