Mixed situation

Mixed situation originally stands in agriculture for the dispersion of individual arable land belonging to an owner over the entire field mark . The word is also used in common parlance for a confusing situation, for example for contradicting interests and intentions of different actors.

Agriculture

The mixed situation was characteristic of feudal agriculture, especially in the south-west German real division areas . Although it made it possible to distribute soils with different yields within a field marrow, it hindered economic development due to the associated land constraints and the usage rights and was eliminated by the agricultural legislation at the end of the 19th century. In the 20th century, land consolidation resulted in the reorganization of agricultural and forestry property in the Federal Republic of Germany ; in the GDR , the so-called agricultural production cooperatives (LPGs) were created through collectivization .

Immission control law

In Section 6.7 of the TA Lärm , a mixed situation is defined as the juxtaposition of commercially, industrially or similarly used areas and residential areas with regard to their noise effects. The specific need for protection of the affected area is decisive for the immission guide values ​​to be observed in each case. The immission guide value valid for the areas used for living can be increased to a suitable intermediate value of the values ​​valid for the adjacent area categories. For areas with diffuse development, however, the guide values ​​for mixed areas are decisive.

When resolving conflicts by means of land-use planning , the principle of separation from Section 50 BImschG must be observed.
