Prosecution

On March 23, 2004, Emig resigned from the head of the sports department of the Hessischer Rundfunk after an internal audit of the broadcaster revealed dubious events in two reports. Emig was arrested on June 28, 2005 because of the risk of blackout in connection with a bribery affair, in which he was accused of an initial suspicion of bribery and anti-competitive agreements in tenders . Because the allegations of the Frankfurt public prosecutor's office could not be cleared up by Emig's lawyers, the HR pronounced his former head of sports on July 14, 2005, giving his former head of sports an extraordinary termination without notice ( suspicion of termination due to fraud, breach of trust and bribery).

On May 4, 2007, the Frankfurt public prosecutor brought charges against Jürgen Emig on suspicion of fraud, embezzlement, corruption and bribery. The public prosecutor's office accused Emig of having smuggled sponsorship funds past the Hessischer Rundfunk via the front company SMP. The co-accused SMP managing director and former president of the German Dance Sports Association Harald Frahm acted as a front man for Emig. Prosecutor Michael Loer said of Emig: "He betrayed the freedom of broadcasting and sold editorial decisions." The prosecutor's claim was three and a half years in prison.

On October 2, 2008, Emig was sentenced by the Frankfurt am Main regional court to two years and eight months in prison for corruption, aiding and abetting bribery and breach of trust. In the grounds of the verdict, the judge attested to the former sports journalist's "brazen approach" and "quite a lot of criminal energy". The court took into account Emig's partial confession and the fact that he was facing financial and social ruin due to the loss of his profession. Frahm was sentenced to a suspended sentence of one year and ten months on October 2, 2008 for bribery and aiding and abetting of breach of trust. He also had to pay a fine of 100,000 euros. Emig appealed against the judgment of the regional court without success, the judgment was confirmed on November 27, 2009 by the Federal Court of Justice .

The labor court in Frankfurt am Main sentenced Emig on April 13, 2011 in another proceeding to pay 1.1 million euros in damages to Hessischer Rundfunk. The dismissal protection suit was dismissed. This judgment was confirmed in terms of content on January 11, 2013 by a comparison of the two parties before the Hessian State Labor Court. Emig was supposed to pay 1.1 million euros to the broadcaster, but the sum should be offset against this in the event of a complete waiver of all claims from his company pension. Originally, the broadcaster demanded 1.78 million euros from Emig.
