The Prussian district order of 1872 reorganized the Prussian districts .

After many years of and sometimes difficult negotiations, the district order came into effect as a law on December 13, 1872 and subsequently formed the basis for a new provincial order .

The law initially only extended to the provinces of Prussia , Brandenburg (including Berlin ), Pomerania , Silesia and Saxony with the proviso that it could be brought into force by royal decree in the province of Posen or parts of it.

Legal Status

Each district formed a local association for self-administration of its affairs with the rights of a corporation . Cities with at least 25,000 inhabitants were allowed to form a city ​​district for themselves. The cities and the administrative districts were members of the circle, insofar as they did not form their own city districts . These in turn comprised several rural communities. The owner or a representative appointed by him was the local authority for the area of ​​an independent manor district . He was responsible for the duties and services that were also incumbent on the rural communities.

Self-management

Each district was empowered to issue orders and regulations as part of its self-administration . The municipalities belonging to the district had to provide a district levy through surcharges on the direct state taxes , in particular on the class and income tax . District members were obliged to accept honorary posts .

District Administrator

At the head of the administration stood the district administrator appointed by the king at the suggestion of the district council . He had a double function as head of self-government and as an organ of state government. At the same time he was chairman of the district council and district committee . He was assigned a district secretary and two elected district deputies . The latter represented him. If he was temporarily unable to do so, the district secretary could do that.

District Committee

A district committee of six members elected by the district council assisted the district administrator in the administration of district affairs and the administration of the general state administration.

District council

The district assembly consisted of at least 25 members. It had to meet at least twice a year. He was elected according to a proportional system in which the residents of the urban parishes - according to their proportion of the population in the district - elected up to half of the members, while the remaining members were equally elected on the one hand by the residents of the rural communities and on the other by the rural landowners who at least 150 to 450 Mark state primary and building control led away. These were indirect elections by electors . The legislative period was six years.
