Max Josef Dietlein
Max Josef Dietlein (born January 8, 1931 in Cologne - † February 6, 2013 ) was a German lawyer , judge , legal scholar and president of the Constitutional Court and the Higher Administrative Court of North Rhine-Westphalia.
Life
Max Josef Dietlein came from a Catholic family. His father Max Dietlein was chief physician at the Augustinian hospital in Cologne from 1924 to 1963. His mother Hedwig Dietlein, née Rust, was involved in the Cologne Catholic Women's Association, of which she later became honorary chairman, and was a member of Helene Weber's (CDU) circle . Dietlein's grandfather Otto Rust was the first attorney general in the attorney general's office in Cologne. Max Josef Dietlein studied law and political science at the Albert Ludwig University of Freiburg and the University of Cologne . During his studies he became a member of the Catholic student association AV Rheinstein Cologne in the CV and the student association AV Edo-Rhenania Tokyo . In 1954 he passed the first state law examination. In 1958 he was in Cologne with the work of the duplicity of marriage forms in the Germanic, Roman, Greco-Egyptian and Indian rights to Dr. iur. utr. PhD. In 1959 he passed the second state law examination in Düsseldorf.
In 1959 he entered the administrative courts in Rhineland-Palatinate, initially as a research assistant at the Trier Administrative Court and later as a judge at the Koblenz Administrative Court. In 1966 he became a senior administrative judge at the Koblenz Higher Administrative Court. In 1968 he joined the Federal Ministry of Justice as a ministerial advisor and from 1971 headed the “civil law” sub-department as ministerial director, and from 1976 deputy head of the civil law department. Here Dietlein appeared as head of the commission for the drafting of the law regulating general terms and conditions (AGB law), which was passed by the German Bundestag on December 9, 1976 and is now part of the civil code . The first book commentary on the AGB law was written by Dietlein together with E. Rebmann (AGB-Aktuell, 1977). In 1980 he became ministerial director and deputy director of the Bundesrat, in this function also managing director of the mediation committee of the Bundestag and Bundesrat.
From 1987 until his retirement, Dietlein was President of the Constitutional Court for the State of North Rhine-Westphalia (VerfGH) and the Higher Administrative Court for the State of North Rhine-Westphalia (OVG) Münster, and also chairman of the 5th Senate of the OVG Münster.
Max Josef Dietlein was a lecturer in public law at Cologne University from 1968; In 1989 he was appointed honorary professor at the Law Faculty of the University of Cologne. He has published numerous academic articles, in particular on topics of civil, administrative and constitutional law.
Dietlein was married and the father of Markus Dietlein , Johannes Dietlein and Thomas Dietlein, who worked as professors at the Universities of Cologne and Düsseldorf .
