Michael Schuster (lawyer)

Michael Schuster (born April 7, 1767 in Prague ; † March 20, 1834 there ) was a Bohemian lawyer and university professor.

Life

Michael Schuster was the son of the university professor Josef Anton Schuster (* 1720, † 1797), who taught nature and criminal law at the University of Prague .

He attended school in Prague and then studied philosophy and law at the University of Prague. On May 14, 1790 , he received his doctorate as Dr. phil. as well as Dr. jur. and subsequently became a lawyer after passing the required test at the Bohemian Court of Appeal .

From 1794 he supported his father, who had been a professor for 40 years, at his chair at the university and was appointed full professor of Roman law on September 26, 1796, as the successor to Joseph Groß (1723-1796) .

In 1810, after the reform, he was the first to hold the chair of Austrian civil law .

In 1812/1813 and 1816/1817 he was Dean of the Faculty of Law and Rector of the University of Prague in 1821/1822 and Vice-Rector the following year . He became a senior law school and an associate member of the academic senate .

By decree of September 3, 1818, he was appointed to the government council.

Michael Schuster was married to Anna (née Eckel) in 1792 and had two daughters and two sons who also became lawyers:

  • Edmund Schuster, received his doctorate from the University of Prague in 1817;
  • Heinrich Schuster, received his doctorate from the University of Prague in 1822.

Writing

After the publication of the General Civil Code , he devoted himself to commenting on it from 1811. In 1819 on building law, prohibition rights, the use and non-use of official buildings, then on the individual categories, ownership and statute of limitations of the same , the 1829 into Italian with the title Del diritto di eriger fabbriche e del diritto di vietarle, dell 'uso e non uso delle servitù was translated. His other treatises appeared in the journal Materials for Law and Justice by Carl Joseph Pratobevera ; However, he mainly published in the magazine for Austrian legal scholarship and political law by Vincenz August Wagner .

  • Michael Schuster was a member of the Patriotic Art Friends Society and represented on its committee.
  • He was a member of the National Museum in Bohemia .
  • He was a member of the Society of Friends of Art for Church Music .
  • There was a membership in the association for the encouragement of the industrial spirit in Bohemia .
  • He was an honorary member of the Bohemian Savings Bank Association .
