The National Anti-Doping Agency Austria GmbH ( NADA Austria ) is the Austrian anti-doping agency.

The World Anti-Doping Agency (WADA) was founded in 1999 as a result of a World Anti-Doping Conference initiated by the IOC with the aim of promoting anti-doping programs at international and national level in terms of detection, deterrence and Harmonize and coordinate the prevention of doping.

The National Anti-Doping Agency (NADA Austria) was founded on July 1st, 2008 as a limited liability company  (GmbH) based in Vienna and is a not-for-profit, independent anti-doping organization. The shareholders are the federal government (53%), the nine federal states (5% each), the Austrian Federal Sports Organization and the Austrian Olympic Committee (1% each). By resolution of the Federal Chancellor, NADA Austria took over the tasks of the independent doping control facility within the meaning of the Federal Anti-Doping Act . The main task of NADA Austria is anti-doping work in sport on the basis of international conventions by means of repression and prevention .

Prevention

NADA Austria defines itself as a service facility for Austrian sport. Their main task is to protect the clean athletes. Violations of the anti-doping regulations caused by ignorance, misconduct or incorrect information should be prevented. For this purpose, NADA Austria offers a whole range of free information and prevention offers. For example, there is an online medication query in which every medication in the Austria Codex can be examined for its admissibility according to the prohibited list, as well as an example list of permitted medications. This service is also available as an app for mobile devices .

The area of ​​responsibility of prevention work includes information, education and awareness-raising about doping in top, competitive, young and popular sport, the promotion of training for athletes in the field of doping prevention and the education of athletes and supervisors before major international competitions.

In order to be able to guarantee these tasks in high quality, there are cooperations with the Ministry of Sports, the Ministry of Education, the Federal Sports Organization, the Federal Sports Associations, the Federal Sports Academies, sports funding institutions, the Pharmacists Association, the Association of Austrian Sports Physicians and major organizers.

The declared aim of NADA Austria's prevention work is for Austrian athletes to make a conscious decision against doping.

Doping control system

Among the control functions, among others, the planning, implementation and monitoring of part of doping control , the application of disciplinary proceedings in the Austrian Anti-Doping Rights Commission (ÖADR), to monitor compliance with the conditions for the promotion of sport , the decision on applications for therapeutic use exemptions and advice medical affairs and reporting on anti-doping rule compliance.

NADA Austria has around 40 doping control teams throughout Austria to carry out doping controls.

The central element of a modern, effective doping control system are unannounced controls, because every warning time can theoretically give those who want to cheat the possibility of manipulation. With the increasingly sophisticated techniques of fraud and manipulation used by doping athletes, the timing of the controls must be chosen wisely. Intelligent doping controls outside of competitions are the core of anti-doping work in addition to constant improvement of analysis methods.

Target controls are carried out if there is suspicion or a high probability of doping. To support them, NADA Austria has set up a selection committee with experts who draw up an annual doping control plan and provide assistance and advice on the implementation of intelligent controls.

Due to the confirmed, high and verified quality standard, which is verified by the ISO certification, NADA Austria is entitled to perform services (e.g. controls) for other anti-doping organizations.

Since January 1st, 2009, NADA Austria has also carried out blood tests in order to be able to examine for prohibited substances and methods that cannot be detected in the urine. Thirteen specially trained doctors are available. Doping samples can be kept for up to ten years for follow-up examinations. If a new detection method is developed, old samples can be re-analyzed. The aim of the control activities of NADA Austria is to guarantee a fair and equitable exercise of sport. By establishing and maintaining international standards, the sporting comparison with athletes from other countries should succeed under the same conditions.

In 2016, a total of 1987 samples were taken (1115 urine and 508 blood samples), which were distributed over various sports areas:

  • 207 Nordic skiing ( ÖSV ) including biathlon and ski mountaineering
  • 119 cycling ( ÖRV )
  • 84 Alpine skiing (ÖSV) incl. Snowboard and ski cross
  • 80 ice hockey ( ÖEHV )
  • 76 Swimming ( OSV )
  • 71 Athletics ( ÖLV )
  • 66 rowing ( ÖRV )
  • 47 volleyball ( ÖVV )
  • 44 Canoe (ÖKV)

In 2017, NADA Austria also introduced a seal of approval for fitness centers and the cooperation partners received the “NADA Anti-Doping Seal of Approval” as part of an information and training program.

Top and basic segment

In 2016 there were around 700 athletes in the national test pool, of which around 190 were in the top segment and 510 in the basic segment. Those athletes who have been assigned to the top segment of the national test pool must also specify an hour for each day in which they will definitely be available for a doping test.

To support its areas of responsibility, NADA Austria has set up a total of four commissions:

  • Medical Commission
  • Selection committee
  • Ethics committee
  • Veterinary Commission

If a violation of the anti-doping regulations is suspected, NADA Austria must submit an application to the independent Anti-Doping Legal Commission (ÖADR). The ÖADR decides instead of the Federal Sports Association to which the athlete concerned belongs. This regulation stipulated in the Federal Anti-Doping Act applies to all federal sports associations. This ensures, on the one hand, consistency and constancy in the sanctioning, on the other hand, conflicts of interest are avoided. The Independent Arbitration Commission acts as the second instance in the anti-doping process.
It is also possible to go to a civil court or to the CAS. Criminal offenses such as possession, trafficking and passing on of prohibited substances or methods are raised by the state investigative authorities (police, customs, public prosecutor's office). The Federal Anti-Doping Act enables cooperation between NADA Austria and state investigative authorities.

The World Anti-Doping Code (WADC) is the basic and general document issued by the World Anti-Doping Agency (WADA) on which the World Anti-Doping Program is built and on which, among other things, regulates. a. the definition of doping, the anti-doping rule violations and their sanctions, the conduct of anti-doping procedures and the competencies and tasks of the signatories of the WADC.

WADC 2015 , which came into force on January 1, 2015, is currently in force. The changes essentially include:

  • The "standard ban" is increased from two to four years for serious offenses.
  • The limitation period for anti-doping rule violations has been increased from eight to ten years.
  • In the future, athletes will be prohibited from working with convicted coaches, supervisors or officials for at least six years.

The Federal Anti-Doping Act (ADBG) forms the basis of Austrian anti-doping work and regulates a. the tasks, rights and obligations of athletes, caregivers, sports organizations and anti-doping organizations. In addition, judicial penal provisions for possession, trade and disclosure (up to five years imprisonment) as well as the cooperation between NADA Austria and the state investigative bodies are recorded in the ADBG.
The ADBG, which came into force on January 1, 2015, meets all the requirements of the World Anti-Doping Code and brings the following major changes:

  • Clear separation between NADA Austria, the Austrian Anti-Doping Legal Commission and the Independent Arbitration Commission
  • Risk assessment at the National Test Pool
  • In anti-doping proceedings it is now possible to have witnesses summoned by an ordinary court if they fail to appear.

NADA Austria follows a request from WADA and publishes the names of the athletes immediately after the positive test of the B sample. NADA Germany, on the other hand, does not reveal the names of the persons concerned in a doping case until the judgment is final.

Tape affair

On December 31, 2009, NADA Austria announced the suspension of Christian Hoffmann on suspicion of blood doping . Hoffmann then declared his sporting career to be over with immediate effect. After almost two years of proceedings, the legal commission of NADA Austria decided to ban Hoffmann for six years for various violations of anti-doping regulations. He himself has always denied the allegations made against him.

The decisive meeting for reaching a verdict on December 5, 2011 was (illegally) recorded by Hoffmann on tape that was leaked to the Kronen Zeitung . The minutes of this recording were published by the Krone and raised considerable doubts as to the objectivity of the proceedings against Christian Hoffmann.

Due to the media pressure that then arose against NADA Austria, the managing director of NADA Austria, Andreas Schwab, was relieved of his office on March 30, 2012 and the legal commission of the Ministry of Sports was dissolved with immediate effect.
In August 2012, Michael Cepic was appointed a new managing director. In May 2018, the Court of Auditors criticized the high costs incurred in 2012 for the replacement of the managing director and the delayed processing of funding.
