The Upper grass road 1 , also watchmakers Häusl was an apartment building in Munich -Obergiesing. The building is registered under the monument number D-1-62-000-4866 as an architectural monument in the Bavarian monument list. The building was illegally demolished in September 2017, which generated a lot of media coverage. The building had previously been empty for two years.

location

The building stood east of the Heilig-Kreuz-Kirche in the Oberen Grasstraße in the Feldmüller settlement , a residential area made up of small houses that were built between 1830 and 1860. The settlement is also listed as an ensemble . The house stood at a height of 535 meters above  sea ​​level .

history

The former craftsman's house was a composite assembly consisting of a ground-floor, plastered solid building with a gable roof in the north and a two-story, plastered solid building with a gable roof and a large dormer window . The core of the building was erected around 1840/45 and rebuilt after it was destroyed in the war in 1944.

On September 1, 2017, the building was illegally demolished by CSH Baubetreuung GmbH. The day before, the police, informed by residents, had been able to prevent the demolition.

Litigation

A fine procedure has been initiated against the homeowner to determine whether the demolition is a criminal offense. Furthermore, the city's lower monument protection authority decreed that he had to restore the Uhrmacherhäusl within two years of the granting of the building permit, taking into account the previous cubature and shape and preserving the existing gable walls and the cellar. He filed a lawsuit against the decision of this ruling with the Administrative Court of Munich, which on July 16, 2019 classified the ruling as unlawful due to a formal error.

For the city, however, there is the possibility of appeal, a new decision or even a procedure against the building contractor. In addition, proceedings are pending against the owner at the prosecutor's office.
