Paul Hans Jaeger

Paul Hans Jaeger (born March 10, 1886 in Laach , † April 30, 1958 in Essen-Rüttenscheid ) was a German politician of the FDP .

Life

The son of a master builder attended elementary school and high school in Kassel . He then did a commercial apprenticeship. From 1922 he was employed by Friedrich Krupp AG , where he rose to head of personnel. In 1952 he retired.

Since 1919 he was a member of the DVP . In 1945 he was one of the founding members of the FDP district association. Between 1946 and 1948 he was chairman of the Niederrhein district . For the FDP he was a member of the citizens' committee between 1950 and 1952. From November 9, 1952, he was a member of the city council of Essen and was elected second mayor on November 18 . From January 22, 1953, Jaeger belonged to the German Bundestag , when he replaced the late Hans Albrecht Freiherr von Rechenberg , until September 7, 1953.

Litigation

Hanns Linhardt , who was next on the North Rhine-Westphalian state list, raised an objection against Jaeger's entry into the Bundestag . The North Rhine-Westphalian state returning officer had not taken him into account because he had meanwhile moved to West Berlin and had chosen Jaeger as a successor. However, on July 1, 1953, the election review committee of the German Bundestag found that Jaeger's move up was illegal and that Linhardt should actually have moved into the Bundestag, but gave Jaeger one month to lodge a complaint with the Federal Constitutional Court. Jaeger's loss of mandate only came into effect on September 7th, when the legislative period of the first Bundestag was already over, so that the mandate revocation was no longer practically effective.

This decision, ultimately made against Jaeger, is to date the only withdrawal of the mandate of a member of the Bundestag following an objection.
