Philippe Malaurie

Philippe Malaurie (born March 7, 1925 in Mainz , † April 1, 2020 ) was a French lawyer . He was a professor of private law at the Panthéon-Assas University in Paris .

Life

Philippe Malaurie was born in 1925 into a bourgeois Catholic French family of Norman and Scottish descent. His father was a lecturer in history and geography at a high school in Mainz and a former infantry officer in the Deuxième bureau de Belfort . With the end of the Rhineland occupation in 1930, the Malaurie family left Mainz for France.

Philippe Malaurie was admitted to the exam for the agrégation des facultés de droit in 1951 . In 1953 he published his dissertation : L'ordre public et le contrat: étude de droit civil comparé .

He taught at the Institut des hautes études in Tunis , then at the Law Faculty of the University of Poitiers . He then taught in Beirut and Phnom Penh . He later taught civil law at the University of Nanterre , where he was Dean of the Faculty of Law and Economics from November 1968 to September 1969 before going to the University of Paris II Panthéon-Assas . After his retirement he was appointed professor emeritus. In 2019 he was appointed Komtur des Ordre des Palmes Académiques .

Malaurie was a renowned specialist in civil law with the peculiarity that he had a broad field of teaching and study that covered practically all of French civil law: he specialized and wrote in family law and notary law (inheritance law, gifts, security law, etc.) also textbooks on personal, property and contract law. He was also responsible for most of the civil law work in the defrénois revision course at Dalloz, generally in collaboration with Professor Laurent Aynès. He was also interested in the history of private law and was the author of an anthology of legal thought in 2000 and co-author of the Court of Cassation's annual report in 1999, dedicated to the 20th century history of this institution on the occasion of the new millennium.
