Jan Pieter Hendrik "Piet Hein" Donner (born October 20, 1948 in Amsterdam ) is a Dutch politician of the Christians Democratisch Appèl (CDA).

Life

Donner grew up in a Protestant family. His father was André Donner , who worked as a judge at the European Court of Justice from 1958 to 1979. After finishing school, Donner studied law at the Free University of Amsterdam , where he graduated in 1974. Donner became a member of the CDA party. From May 17, 1994 to February 22, 2007, Donner was a member of the Second Chamber of the States General . From July 22, 2002 to September 21, 2006 Donner was Minister of Justice in the cabinets Balkenende I , Balkenende II and Balkenende III . In 2006 Donner resigned as Minister of Justice. The trigger was a public report on the causes of the deaths of eleven people in a fire at the Schiphol Airport prison .

From February 22, 2007 to October 14, 2010, Donner was Minister of Social Affairs and Employment of the Netherlands in the Balkenende IV cabinet . He was then Minister for Internal Affairs and Kingdom Relations in the Rutte I Cabinet . On December 16, 2011, he resigned to assume the office of Vice President of the Raad van State (Council of State). He held the office of Vice President from February 1, 2012 to November 1, 2018. He has been Minister of State since December 2018 .

Donner lives in The Hague and is a member of the Protestant Church in the Netherlands .

Controversial statements about a possible introduction of Sharia law

In 2006, his statements as Justice Minister about the conceivable possibility that the Sharia , i.e. the Islamic law of God, could one day be constitutionally anchored in the Netherlands in a democratic way , provoked a wave of protests:

“For me it is certain that if two thirds of all Dutch people want to introduce Sharia tomorrow, then this possibility must be given. Could it be thwarted legally? It would also be a scandal to say 'that is not allowed!' The majority counts. That is the essence of democracy. "

This statement was categorically rejected by parties from all political backgrounds, as well as by a Muslim leader.

His critics countered him that the Sharia is not compatible with the European Convention on Human Rights of the Council of Europe, which is applicable law in the Netherlands - as in the entire EU . The European Court of Human Rights in Strasbourg (ECHR) ruled in several proceedings that the Sharia was “incompatible with the fundamental principles of democracy”.
