Reinhold Baumann

Reinhold Baumann (born October 3, 1924 in Lindorf ; † August 19, 2016 ) was a German administrative lawyer. From 1983 to 1988 he held the office of the Federal Commissioner for Data Protection .

Life

After graduating from high school in 1942, he was drafted into the Reichsmarine . He studied at the University of Tübingen Law and was in WS 1947/1948 member of the Tübingen fraternity Derendingia . Baumann received his doctorate in international civil procedural law in 1953. From 1973 to 1983 he headed a subdivision in the Federal Ministry of the Interior. In the Federal Ministry of the Interior, he played a key role in the formulation of the Administrative Procedure Act , which came into force in 1976.

At the instigation of Federal Interior Minister Friedrich Zimmermann (CSU), Baumann was appointed Federal Commissioner for Data Protection (BfD) in 1983. The news magazine Der Spiegel claimed at the time that Baumann's appointment was the result of a post push. Baumann himself declared when he took office that the material was still foreign to him and that he had not applied for the office. Nor is he of the opinion that data protection should always take precedence in cases of doubt. Public safety and data protection are fundamentally of equal weight.

As a BfD, Baumann tried to balance the interests of the citizens with the interests of the state. He did not shy away from demanding more posts for his authority and taking a confrontational course on individual issues, for example with regard to data processing by the intelligence services.

During Baumann's tenure, the so-called census ruling was issued , which is considered a milestone in the development of data protection .

Baumann was married to Hannah Baumann geb. Unterberger (1931–2016), daughter of the Austrian doctor Siegfried Unterberger .
