The Supreme Court is the supreme court as well as the constitutional court of Namibia .

The court is legally based on Section 79 of the Constitution of Namibia and the drafting in the Government Gazette, No. 84 of October 8, 1990 .

The court has its seat in the capital Windhoek . Currently (as of September 2017) has " his lordship the honorable Chief Justice" ( English His Lordship, the Honorable Chief Justice ) Peter Shivute held the highest judicial office.

history

The Supreme Court was established with independence on March 21, 1990. The Court of Justice is both the Supreme Court and the Constitutional Court in the country. It is the first dish of its kind in what is now Namibia. In the times of South West Africa , all decisions had to be confirmed by the Supreme Court in South Africa .

Courthouse

The Supreme Court building was built in Windhoek-Central in the early 1990s . It was designed by a Namibian architecture firm from Swakopmund . The building was planned based on North African buildings and should be clearly different from the European buildings of the years under foreign rule. Particular attention was paid to the two-sided arcades and the garden, which was planted exclusively with Namibian plant down.

Inside the building, in addition to the library founded in 1997, there is also the public foyer and the courtrooms with visitor galleries and the memorial garden, which are arranged around an inner courtyard .

Judge

The Chief Justice presides over the Supreme Court as the highest judge. He is supported by additional judges, of which the Judges of Appeal stand above the Acting Judges . All of these are appointed by the President of Namibia as chairman of the Judicial Service Commission .

Chief Justice

Since the court was founded with Namibia's independence in 1990, there have been various presiding judges . The presiding judge of the previous court Supreme Court of South West Africa (Supreme Court of South West Africa ), HJ Berker, 1990 was the first Chief Justice of Namibia. After his death in 1992, the constitutional judge I. Mohammed took over the office. In 1999 he resigned from his position and GJC Strydom, up until then Chief Justice of the High Court , became Chairman of the Supreme Court. He was succeeded by Peter Shivute after his resignation in 2004 .
