The Trust Act established since 1 July 1990 the status and activities of and 2008 settled previously founded THA and its successor organizations and since then regulates the activities of authorities responsible for implementation of outstanding tasks Bundesanstalt für vereinigungsbedingte Sonderaufgaben (BvS), the liquidators, the Institute for Federal Real Estate (BImA) is or the activity of the agency commissioned by the BvS.
With the Trusteeship Act, the de Maizière government, which emerged from the last Volkskammer election in 1990 , regulated the transfer of the state- owned companies of the GDR into private ownership by the Treuhandanstalt. The "institution for the fiduciary administration of public property" had already been established on March 1, 1990 by the then Modrow government .
The new establishment under public law under the Trust Act was constituted on July 16, 1990 and took over the approximately 8,500 formerly state-owned companies in the register of the " Establishment for the fiduciary administration of public property" as the new owner on July 1, 1990 (when the law came into force) state-owned economy , which had been transferred to trustee management on the basis of the statute of March 1, 1990.
The Trusteeship Act repealed the old statute, which the institution was still subject to the People's Chamber and did not authorize interventions in the management . On the basis of the State Treaty on Monetary, Economic and Social Union concluded by the new government on May 18, 1990, it pointed beyond the reunification of Germany and subordinated the new institution to the government - until October 3, 1990 initially to the last Council of Ministers of the GDR , then the Federal Ministry of Finance . It now also authorized extensive interventions in the management of the company.
The Trust Act is still in force after the trust agency has been wound up in 2008, due to the fact that the tasks have not yet been fully completed, especially legally.
