The constitution of Berlin ( short: VvB ) is the state constitution of the German state of Berlin .

Current is the constitution of November 23, 1995, which was passed by the Berlin House of Representatives on June 8, 1995 and approved by a majority of the Berliners in the referendum on October 22, 1995, with the following changes ( see info box with the basic data ).

It replaced the constitution of September 1, 1950. There were significant additions to the previously applicable constitution in Section II: The catalog of basic rights was expanded, state goals were newly introduced into the constitution and the prohibition of discrimination was established for the first time. In Section III, the rights of MPs were extended and the office of data protection officer was established. Section V has been expanded to include options for people's legislation in a three-stage process of popular initiative , referendum and referendum . Section VII finally laid the foundation for the constitutional court of the state of Berlin .

The constitution of 1950 already claimed validity for the whole of Berlin in its Article 4, but until reunification could de facto only be enforced in West Berlin and not in East Berlin . Since January 11, 1991, it was then valid for all of Berlin.

The constitution of Berlin has no relation to God . Protection against discrimination based on sexual orientation has been added to Article 10 (2 ).
