Administrative community (Upper Austria)

In Upper Austria, an administrative community describes the establishment of joint municipal offices by several independent municipalities and, since 2016, the establishment of a de facto joint district administration for several districts.

Administrative communities of municipalities

The establishment of administrative communities is through § 13 Upper Austria. Municipal code (Upper Austrian GemO 1990) made possible. There it is described that the municipalities can agree on an administrative community "for the joint management of their affairs". This can be done by means of concurring municipal council resolutions, and regulations on the seat, designation, management, participation in the expenses and dissolution of the administrative community must also be made with such a resolution. The establishment or dissolution of an administrative community must be reported to and approved by the state government . Furthermore, the state government has extensive rights in the context of disputes among the municipalities involved and can dissolve administrative communities according to the legally defined requirements even against the will of the respective municipalities.

Through the establishment of the administrative community, the existing municipal offices of the municipalities are often amalgamated and given a common head of office . The previously existing locations either remain or will be transformed into a main location with branch offices in the other municipalities. These structural changes then run through all areas of the tasks to be carried out by the community, such as schools , kindergartens , building yards, etc.

The districts of Eferding and Grieskirchen in Upper Austria

With effect from September 1, 2016, the Upper Austria. Administrative community ordinance ordered the relocation of the district administration Eferding to Grieskirchen under the leadership of the district administration of Grieskirchen . The existing districts of Eferding and Grieskirchen were retained, but are only managed from one location. In Eferding , instead of the previous district administration, a citizen service point has been set up to issue documents such as passports and driving licenses. The two district authorities continue to exist formally, but they are linked by a personal union: both authorities are headed by the same district captain and have the same staff. With effect from January 1, 2017, the district police commanders Grieskirchen and Eferding were merged, and many organizations that had previously followed the political districts in their organizational structure ( Red Cross , fire brigade ) reacted .

Governor Thomas Stelzer emphasized the possible annual savings of 13 full-time employees - around 700,000 euros per year - which should increase to a total of 23 saved full-time employees by 2020. The establishment of the administrative community was criticized by the Greens , who saw it as a "door sign exchange campaign", since the two districts would remain with their respective tasks and the citizens of Eferding would now be compelled to go to Grieskirchen to "deal with the authorities" ".

The administrative community of Eferding and Grieskirchen is so far the only one of its kind in Austria .

The Upper Austrian provincial government is now also thinking of expanding the already existing cooperation between the three statutory cities Linz , Wels and Steyr with their respective surrounding districts within the framework of the administrative communities.
