Viktor Capesius

Viktor Capesius (born December 9, 1867 in Sibiu , † March 3, 1953 in Vienna ) was an Austrian lawyer.

Life

Capesius grew up in Vienna since 1869, where his father worked as a lawyer and was active as a presbyter in the Evangelical Lutheran parish. After studying law, which he completed with a doctorate to become a Dr. jur. graduated, he was first a judge in Neunkirchen (Lower Austria) , later at the Regional Court for Civil Law Matters in Vienna and finally a councilor at the Higher Regional Court in Vienna . On April 8, 1925 he was appointed President of the Upper Church Council of the Evangelical Church A. u. HB ordered in Austria . Since this was an authority subordinate to the Ministry of Culture , Capesius was also head of section there . His main merit was the implementation of the basic features of the church constitution, which was passed by the Synod in 1925 and finally passed in 1931, which, however, was not recognized by the state.

In the Austro-Fascist corporate state , however, Capesius found himself more and more in a difficult position. Thanks to the constitution of 1934 he was also a member of the State Council and was therefore viewed with suspicion by the predominantly German-national oriented pastors. When Chancellor Kurt Schuschnigg had a referendum prepared in March 1938 to prevent the threatened annexation of Austria to National Socialist Germany , Capesius supported him. After the referendum was canceled, the Nazi-friendly forces in the church urged him to resign, the new rulers put him on leave and put him into permanent retirement on the first of the next month. His successor was Robert Kauer .
