The Labor Market Service (AMS) is a service company on the labor market in Austria . It fulfills the functions of a public employment office and places workers for vacancies and supports the initiative of the unemployed and companies as employers through advice, information, qualification and financial support.

Pursuant to Section 29 AMSG , the aim of the Public Employment Service is to work towards the most complete, economically sensible and sustainable merging of labor supply and demand within the framework of the full employment policy of the Federal Government to prevent and eliminate unemployment while maintaining social and economic principles in the sense of an active labor market policy.

With the AMSG of July 1, 1994, the Labor Market Administration (AMV) was spun off from the Federal Ministry of Labor, Health and Social Affairs and the Labor Market Service (AMS) was constituted as a service company under public law .

The labor market service is divided into one federal, nine state and 104 regional organizations (including 6 branches). At all these levels, the social partners (representatives of the Chamber of Commerce , Federal Chamber for Workers and Salaried Employees , Austrian Trade Union Confederation and Association of Austrian Industry ) are involved in the business and work at every organizational level to shape labor market policy (work programs of the federal states) and to control the organization With. The administrative board acts at the federal level.

The executive bodies are responsible for carrying out the tasks:

  • at the federal level to the board,
  • at the state level to the state manager
  • at regional level to the head of the regional office.

The respective management is supported in the implementation of the labor market policy by offices.

In 2017, 5,606 positions (calculated in full-time positions) with 6,284 employees were filled as of December 31, 2017. In addition, around 74 apprentices work at the AMS, 44 of whom are women.

The budget for 2019 envisages that up to 200 posts will be cut by the end of 2020.

Jobseeker Placement

The most important task of the AMS is the placement of job seekers for vacancies . The unemployment in Austria declined as a result of the economic crisis of 2009 clearly. In 2010 and 2011, unemployment fell again, but was nowhere near the 2008 level. A slight increase in unemployment is forecast for 2012. Within the EU, Austria has the lowest unemployment rate of all EU countries.

The award of contracts for the holding of courses has been standardized since 2002: Up until then, the federal, state and local governments had their own implementation rules. Institutes that offer courses in the field of adult education must reapply for the courses that have already been held. The criticism is repeatedly expressed that as a result there is often competition for price (cheapest bidder), but no quality competition (best bidder). Further training for jobseekers

Around 50,000 jobseekers are trained on average per month by the Public Employment Service in various training courses with the aim of improving their job market opportunities ( professional development ). Jobseekers are not listed as such in the official official statistics if they are in training and coaching courses, but also if they are on sick leave , have a withdrawal ban or receive the pension advance. This is seen by critics as a way of disguising the real unemployment. The Public Employment Service itself contradicts this argument and points out that the number of people in training is shown separately.

Benefits under the Unemployment Insurance Act

According to the Unemployment Insurance Act (AlVG), the AMS is responsible for the following benefits:

Women who were entitled to unemployment benefit could receive parental leave benefit from the AMS for births before July 1, 1997 . Due to a change in the law, the regional health insurance funds are responsible for births afterwards . In 2002, the parental leave allowance was replaced by the child care allowance , which is also paid out by the health insurance companies.

Criticism came in May 2006 from the Court of Auditors , which found the AMS Vienna to be inefficient and also saw the privacy of the customers being injured by the accommodation of several team members in the same room without spatial separation.

In 2003 the AMS was criticized by the data protection organization ARGE Daten because the social security number was required for a certain offer on the World Wide Web . According to legal requirements, this is only to be used for health-related matters.

The AMS initially planned the nationwide introduction of a computer-aided classification of job prospects for the unemployed in mid-2020. Due to the COVID-19 pandemic , the planned start has been postponed to the beginning of 2021. In August 2020, the data protection authority decided that the project could not be implemented because the legal basis for profiling would be missing.
