Central Register of Foreigners

The Central Register of Foreigners ( AZR ) is a database operated by the Federal Office of Administration (BVA) in which personal data records of foreigners are stored. The approximately 20 million personal data records stored in the AZR also include data from 4.47 million EU citizens (as of February 2009).

On the basis of the Data Exchange Improvement Act ( BGBl. I p. 130 ), which came into force on February 5, 2016 , it was possible to add new data to the basic personal details already stored in the AZR, such as names, date and place of birth and nationality, in particular with fingerprints . The AZR, which has been the central information platform for foreigner data for years, will in future also serve as the core data system (KDS) in the context of refugee management.

Content and access

Stored data of foreigners in Germany that a residence permit have or have had, as well as those that asylum desire had sought or accepted asylum seekers are.

Basic personal details, alias personal details , processing notes (including the responsible immigration authorities and file numbers ), expulsions , deportations (each with further information), rejections , requirements , restrictions, visas , etc. are saved.

The register is kept by the Federal Office for Migration and Refugees (BAMF) and operated by the BVA. The AZR is one of the most extensive automated registers of the public administration in Germany.

6,500 partner authorities have access to this large database, including a. all immigration authorities , the BAMF, the Federal Government Commissioner for Migration, Refugees and Integration and the German police and customs services (via INPOL-new ).

Legal basis

The legal basis for the AZR is the AZR Act ( BGBl. I p. 2265 ) of September 2, 1994. a. the Regulation implementing the Law on the Central Register of Foreigners (AZRG DV) of 17 May 1995 (BGBl. The predecessor of the Central Aliens Register was the Central Aliens Register introduced in 1938. criticism

Data protectionists have long criticized the AZR. In 2000, the Federal Office of Administration was given a Big Brother Award for operating the Central Register of Foreigners, as this represented “institutionalized official discrimination against non-German citizens in the Federal Republic”.

The European Court of Justice ruled in December 2008 (Case C-524/06) that the AZR on EU citizens may only store such data that is absolutely necessary for the application of legal residence regulations. Use of the data to fight crime and for statistical purposes is not permitted.

Plans for an expansion

According to the coalition agreement of 2018 , the AZR is to be further developed in cooperation with the federal states “into a central foreigner file system that meets all contemporary requirements”.
