Accompanied driving

Accompanied driving (BF 17), colloquially also a driver's license from 17 or driver's license at 17 , is a special regulation in Germany for the admission of people to road traffic . It enables young people to acquire a class B or BE driving license at the age of 17 . However, this driving license is subject to the condition that you only drive with an accompanying person named in the examination certificate . The trial period is two years, as is the case with the regular acquisition of a driver's license. The aim of the regulation is to reduce the high accident rates among novice drivers, as they often do not yet have the necessary experience but are willing to take risks .

Lower Saxony model test

Accompanied driving was originally a model test by the state of Lower Saxony , which was significantly funded by the then Transport Minister Walter Hirche .

The model experiment in Lower Saxony was sharply criticized by various interest groups (e.g. ADAC ) and lawsuits were threatened against it. Road safety in Germany was seen to be seriously endangered.

The background was that some federal states and the ADAC favored a different model. According to this, the normal probationary period for the first acquisition of a driving license should be shortened if the applicant had taken part in safety training .

Nevertheless, Lower Saxony started its own model test on April 30, 2004. The conditions were different from the later national model:

  • Accompanying persons were only allowed to be the legal guardians. However, these did not have to meet any further conditions. They didn't even have to have a driver's license and were allowed to be under the influence of alcohol while driving.
  • The applicants had to agree that their data (accidents, points) could be statistically evaluated during the trial period. This evaluation was carried out by a research group from the Justus Liebig University in Giessen.

The first successful practical driving test as part of the Lower Saxony model test took place on May 19, 2004 in Braunschweig .

Result of the Lower Saxony model test

The effects of the model experiment in Lower Saxony were monitored and statistically evaluated by a research group at the Justus Liebig University in Giessen. The final report of the scientific evaluation was announced by Minister Walter Hirche on July 12, 2007.

Then the participants in the Lower Saxony model test have after the support phase

  • 28.5% fewer accidents and
  • 22.7% fewer traffic violations

as a novice driver in a control group who had regularly obtained their driver's license at the age of 18. The positive effects of accompanied driving at 17 were clearly demonstrated.

Until August 1, 2010, uniform nationwide regulation

On June 17, 2005, a draft law was introduced in the Bundestag to amend the Road Traffic Act and other regulations, which paved the way for a nationwide regulation of accompanied driving from 17 . The Federal Council approved the draft law in its session on July 8, 2005. The legal basis is now the newly created § 6e Road Traffic Act (StVG) and § 48a Driving License Ordinance (FeV) . However, each federal state was free to decide whether to apply the regulations and enable the applicants residing there to be accompanied by driving .

Lower Saxony adopted the national regulation on March 1, 2006 and abolished its own regulation. Little by little, all federal states have adopted the nationwide regulation of accompanied driving . Baden-Württemberg was the last of the 16 federal states to introduce accompanied driving on January 1, 2008.

The rule was initially limited to August 1, 2010. According to Section 65 (12) of the Road Traffic Act, Section 6e (1) and (2) of the Road Traffic Act as well as the statutory ordinances issued on the basis of these provisions, now Section 48a of the Driving License Ordinance, should no longer apply after August 1, 2010. It was still just a model test that still had to be evaluated ( Section 48b of the Driving License Ordinance). A driving license issued up to August 1, 2010, however, remained valid. Federal Transport Minister Ramsauer announced that he would like to continue the regulation indefinitely and that he would introduce a corresponding bill into the Bundestag in 2010.

Transfer to permanent right

On June 17, 2010, the Bundestag approved the regulation that accompanied driving will be included in the permanent right. The Federal Ministry of Transport, Building and Urban Development (BMVBS) announced on 4 August 2010 that the Cabinet a proposal by Federal Minister Ramsauer agreed and a corresponding legislative proposal amending the Road Traffic Act has been launched.

Since January 1, 2011, accompanied driving has been part of the permanent right. Participation in accompanied driving is voluntary and must be expressly requested. The minimum age of 17 years remains the rule.

Companion

According to the nationwide regulation, only persons who are at least 30 years old and at least five years in possession of a valid driving license of at least class B or old class 3 are permitted as accompanying persons. You may not have more than one point in the register of fitness to drive at the time you apply for your driving license .

The number of accompanying persons is unlimited. The accompanying persons must be named when applying and declare their consent.

In contrast to a driving instructor, the accompanying person may not intervene in the operation of the vehicle. She is not the responsible driver of the vehicle. The accompanying person can ride in any passenger seat of the vehicle.

Accompanying persons are not allowed to reach the 0.5 alcohol limit and not be under the influence of other intoxicating substances.

The accompanying person is obliged to carry their driving license with them and to hand them over to the responsible persons on request.

Contrary to the original plans, it is not mandatory for the accompanying person to attend a preparatory or information event on the subject of accompanied driving . However, it is strongly recommended on a voluntary basis in order to familiarize yourself with the rights and obligations as an accompanying person.

Accompanied driving is not permitted abroad. Only in Austria is the test certificate from the German BF17 recognized. Conversely, in Germany the Austrian L-17 driver's license is only valid under certain conditions.

Examination certificate

The theoretical examination can be taken at the earliest three months, the practical examination one month before the age of 17 at the earliest.

If the applicant has already reached the age of 17 at the time of the practical examination, a so-called examination certificate (DIN A5 upright) will be issued after passing the practical examination . This entitles you to drive with an accompanying person throughout the Federal Republic of Germany, but not abroad (exception: Austria). Since the examination certificate does not have a photo of the holder, a photo ID must also be carried.

If the applicant has not yet reached the age of 17 at the time of passing the practical test, he will only receive a so-called test certificate from the driver's license examiner . This only documents the passed test and does not entitle you to drive. At the age of 17, the applicant can then collect the final examination certificate from the responsible traffic authority.

Since the driving license class B also includes the classes AM ( mopeds and quads ) and L ( tractors ) and these classes can be acquired at the age of 16, the test certificate is also valid as a driving license for classes AM and L. The requirement of the accompanying person only applies to vehicles of the classes B and BE, therefore vehicles of the classes AM and L can be driven from the beginning without an accompanying person, but only within the Federal Republic of Germany. On request, however, a regular card driving license for classes AM and L can also be issued, which can also be used for international driving.

At the age of 18, the holder can exchange the test certificate at the responsible road traffic authority for a regular driving license. The examination certificate loses its validity three months after reaching the age of 18. The holder can therefore drive with the examination certificate up to three months after their 18th birthday . The requirement to only drive in company no longer applies on the 18th birthday.

If the learner driver has applied for accompanied driving but has reached the age of 18 during the driver training, he will also be given a test certificate if he passes the practical test. However, it differs from the test certificate for 17-year-olds in that it does not entitle you to drive, but has to be exchanged for a driving license at the road traffic office.

Consequences of violations

Driving without a registered companion or a special certificate does not qualify as driving without a driver's license according to Section 21 of the Road Traffic Act (StVG) . There is a risk of a fine of 70 euros and a point in the register of fitness to drive . In addition, the driving license is revoked and may only be re-issued after participating in an advanced seminar . There is no special blocking period after participating in an advanced seminar.

Failure to carry the test certificate with you is subject to a fine of ten euros (see also Driving without a driver's license ).

According to statistics from the Federal Motor Transport Authority (KBA), 1,022,854 initial tests for driving license classes B and BE were carried out in 2008, 359,649 (~ 35%) of them as part of accompanied driving at the age of 17 . That is 90,692 or 33% more initial exams than in the previous year (2007). In 2013, 717,907 driving licenses in classes B and BE were issued, of which 318,164 (~ 44%) were 17-year-olds.

Accompanied driving at the age of 16

In mid-April 2018, the federal states' transport ministers confirmed that they wanted to lower the minimum age to 16 years. This would require an amendment to the Driving License Directive 2006/126 / EC. The EU Driving License Committee did not put the issue on the agenda until May 2019. A model test for BF 16 would require the support of other countries. A start is therefore not expected before 2021.

Accompanied driving in the truck

The German Road Safety Council (DVR) recommends allowing accompanied driving in trucks . This is intended to make dual training as a professional driver more attractive and improve its quality.

Regulations in other countries

In France, accompanied driving must have a Conduite accompagnée sticker attached to the vehicle.
  • A similar model is the so-called L17 training in Austria.
  • In France, it has been possible to drive accompanied by children from the age of 16 since 1989 (15 years since 2014). A parent who can provide evidence of at least five years of driving experience is provided as an accompanying person. A Conduite accompagnée badge visible to all road users must be attached to the (usually parental) vehicle . It is recommended to equip the vehicle with additional rear-view mirrors (similar to the driving school vehicles).
  • An Accompanied Driving Permit can be obtained in Canada provided the novice driver is accompanied by an adult who has held a driver's license for at least two years.
  • In the United States of America, the regulations for obtaining a driver's license are subject to the often different regulations of the individual states. In Michigan, the Graduated Driver Licensing program enables accompanied driving to be possible from the age of 14 years and 9 months.
  • In Switzerland, accompanied driving is permitted from January 1, 2021; However, only from the age of 17, the Touring Club Switzerland (TCS) requires a learner's license from 16 years.
