Bernhard Wolff (judge)

Bernhard Wolff (born September 1, 1886 in Berlin , † September 25, 1966 in Karlsruhe ) was a German lawyer , judge at the Federal Fiscal Court and judge at the Federal Constitutional Court .

Life

Bernhard Wolff was the grandson of Eduard von Simson , the first President of the Imperial Court , and the brother of the legal scholar Ernst Wolff . He attended high school in Berlin, and then studied at the University of Law . He passed his state law exams in 1907 and 1913. He then worked until 1914 as a lawyer for Prince Donnersmarck . After four years of service in the First World War , he took over the management of the tax office of the Darmstädter Bank in 1920 . Three years later he rose to the position of chief counsel of the financial institute, which had now merged with the National Bank for Germany to form the Darmstädter und Nationalbank .

From May 1932 to November 1938 he worked as a lawyer in Berlin, and probably also as a notary until 1935. In 1938 he was struck off the list of attorneys and emigrated to England in December of the same year . Here he earned his living as a teacher from April 1939. He has taught at Gordonstoun and Epsom College private schools . He was interned between May 1940 and March 1941.

After his return to the Federal Republic in May 1946, he was appointed head of the legal department of the Central Office for Economic Affairs in the British Zone , which had its headquarters first in Minden and then in Höchst . From 1947 he was also employed in the administrative office for the economy of the American and British occupation areas. From 1948 to 1950 he worked in the legal department of the British Control Commission .

In October 1950 he was appointed judge at the Federal Fiscal Court. He stayed there for less than a year, since he was appointed to the Federal Constitutional Court in September 1951 . Until 1956 he was a member of the second Senate. In particular, it shaped the jurisprudence on the requirement of certainty for the basis of authorization to issue statutory ordinances ( Art. 80 (1) sentence 2 GG). On the occasion of his retirement, Wolff was awarded the Great Cross of Merit with a Star . He died in Karlsruhe in 1966.
