The District of procedure for the Free State of Bavaria governs in Bavaria one as the third municipal level over the municipalities (first level) and circles (second level) appointed municipal authority . The term district is defined in Article 1 of the District Code for the Free State of Bavaria as follows:

"The districts are regional authorities with the right to regulate and administer supra-local matters within the framework of the law that go beyond the jurisdiction or the capabilities of the districts and independent municipalities and whose importance does not extend beyond the area of ​​the district."

According to Article 9 Paragraph 1 of the Constitution of the Free State of Bavaria , the Bavarian State is divided into districts , which in practice have been called administrative districts or districts since the adoption of the District Code in 1953 . District and administrative district are geographically identical in Bavaria, but legally different constructs. With the district reform of 1978, the districts became an independent third municipal level. Their rights and their position alongside the governments were strengthened, the administrations of the districts were separated from the governments.

Article 7 of the district regulations for the Free State of Bavaria regulates the area of ​​a district. It consists of "[The] total area of ​​the districts and municipalities assigned to the district [...]" This level exists in Germany except in Bavaria, for example, in the formerly Bavarian Palatinate in Rhineland-Palatinate (see also under District Association Palatinate ) or in the Stuttgart region in Baden-Württemberg , in a broader sense ( higher municipal association ) also in Lower Saxony and North Rhine-Westphalia ( regional associations ) as well as in Hesse and Saxony (state welfare associations ).
