The State Secretariat for Migration SEM ( French Secrétariat d'Etat aux migrations SEM , Italian Segreteria di Stato della migrazione SEM ) is a federal authority of the Swiss Confederation .
It is responsible for matters with foreigners in general (issuing entry visas, entry bans, naturalization, etc.) and for the recognition of foreign refugees (recognition and revocation of asylum ). The SEM is subordinate to the Federal Justice and Police Department FDJP .
Until December 31, 2014, the authority was called the Federal Office for Migration (FOM).
organization
The original Federal Office for Migration (FOM) was created through the amalgamation of the Federal Office for Refugees (BFF) and the Federal Office for Immigration, Integration and Emigration (IMES) on January 1, 2005. On January 1, 2015, the FOM became the State Secretariat for Migration ( SEM) renamed due to the "growing importance" and the "more extensive area of responsibility".
Mario Gattiker is the director of the State Secretariat ; he headed the position on an interim basis from November 2011 and officially since 2012. He replaced Alard du Bois-Reymond , who headed the office from January 2010 to the end of October 2011.
The SEM is divided into a staff department and four main departments:
- Planning and resources;
- international cooperation;
- Immigration and integration;
- Asylum and return.
The SEM has 729 jobs and an annual expenditure of around 1,127 million Swiss francs . The State Secretariat also employs experts and interpreters who translate during surveys. These are used when necessary and are reimbursed for their services according to the effort.
Headquarters and branches
The headquarters of the State Secretariat is in Wabern . In addition, six reception and processing centers (EVZ) for asylum seekers are operated, which take care of the reception of asylum seekers at the Swiss borders and a summary survey on the travel route and the reasons for asylum. Since 2005, decisions on asylum applications have also been made there. The reception and processing centers are in Altstätten , Basel , Bern , Chiasso , Kreuzlingen and Vallorbe . The SEM also has a department at Zurich Airport and Geneva Airport .
Responsibility and legal basis
The State Secretariat is responsible for:
- Guarantee of a policy on foreigners led by Switzerland , in particular:
- the admission and residence of foreigners in compliance with international law obligations and taking into account humanitarian reasons and the reunification of families.
- the admission of foreign workers taking into account macroeconomic interests, long-term professional and social integration opportunities as well as the scientific and cultural needs of Switzerland; (Legal basis: Federal Law on Residence and Settlement of Foreigners).
- Implementation of the Swiss asylum and refugee policy. The State Secretariat for Migration is responsible for the entire asylum procedure. As an investigative authority, it must determine the legally relevant facts. The procedure is based on the Asylum Act and the Federal Act on Administrative Procedure. The basis is the Convention of November 4, 1950 for the Protection of Human Rights and Fundamental Freedoms .
- Creation of favorable framework conditions for the integration of the foreign population living in Switzerland and for balanced demographic and social development.
Asylum procedure
The asylum procedure is handled by the SEM as
- «Without additional clarifications» (quick processing) or
- "With additional clarifications"
classified. A distinction is made here between a material review of an asylum application and failure to respond to the asylum application (decision not to apply).
Additional clarifications include: Expert reports and reports, such as clarifications regarding socialization in the respective country of origin, an additional survey by the responsible clerk at the headquarters in Bern-Wabern and embassy inquiries from Swiss diplomatic missions abroad and their confidants.
After submitting an asylum application in Switzerland, personal data including fingerprints and photographs are collected from the asylum seekers at the EVZ . After a mostly short-term admission to the respective EVZ, the asylum seekers are assigned to a canton of residence according to a distribution key introduced for this purpose, so that the asylum seekers are evenly distributed in Switzerland. All documents and other correspondence are written in one of the official languages of the respective canton of residence to which the asylum seeker was assigned.
If an asylum application is rejected, a complaint can be lodged with the Federal Administrative Court (BVGer) against the relevant SEM ruling . This replaced the Swiss Asylum Appeal Commission (ARK) from January 1, 2007 and took over the proceedings pending there.
The processing deadlines for a complaint procedure were set in the new version of the Asylum Act from January 1, 2008; It makes a difference whether the procedure was dealt with with or without additional clarifications. Complaints in the event of non-acceptance are dealt with quickly as a priority. Due to the large number of pending complaint proceedings, it remains questionable for the time being whether the statutory treatment deadlines can be met. In July 2007, 6,462 cases were pending before the Federal Administrative Court.
The State Secretariat publishes monthly statistics on the asylum system on its website.
