Dieter Hömig

Dieter Hömig (born March 15, 1938 in Sigmaringen ; † October 18, 2016 ) was a judge at the Federal Constitutional Court from 1995 to 2006 .

In 1957 Dieter Hömig did his Abitur at the Dillmann-Gymnasium , which at that time was housed in the building of the Königin-Katharina-Stift due to the destruction of the old schoolhouse in the Second World War .

He studied law in Freiburg im Breisgau and Tübingen . During his studies he became a member of the Tübingen student association “ Akademische Gesellschaft Stuttgardia ”. After the second state examination, Hömig worked from 1967 to 1983 as a civil servant in the Federal Ministry of the Interior .

In 1969 he received his doctorate in Tübingen with a thesis on the Reichsdeputationshauptschluss of February 25, 1803 and its importance for state and church: with special consideration of the situation in Württemberg .

In 1983 Hömig was appointed judge and in 1993 he was appointed presiding judge at the Federal Administrative Court.

Hömig as a judge at the Federal Constitutional Court

From October 1995 to April 2006, Hömig was a member of the First Senate of the Federal Constitutional Court. Michael Eichberger became his successor in the office of Federal Constitutional Judge .

Hömig was elected to the Federal Constitutional Court at the suggestion of the FDP . As a rapporteur, he was responsible for freedom of religion and belief , school law as well as property and company-related property issues in connection with the establishment of German unity and, among other things, the decision of the Federal Constitutional Court on the spelling reform of July 14, 1998 (Az. 1 BvR 1640/97) , the decision on slaughtering of January 15, 2002 (Az. 1 BvR 1783/99), the fighting dog decision of March 16, 2004 (Az. 1 BvR 1778/01) and the decision on the Aviation Security Act of February 15, 2006 (Az. 1 BvR 357/05).

He described himself as social liberal, which is why his departure was interpreted as the end of a structural social liberal majority in the First Senate of the Federal Constitutional Court. Among other things, because of his vote on the decision of the Federal Constitutional Court of July 17, 2002 (Az. 1 BvF 1/01 and 1 BvF 2/01) on the Civil Partnership Act , the state of Bavaria's complaint against the law failed . In addition, he was granted a special meaning within the First Senate, as he was able to achieve majorities within the Senate through mediation.

He was the editor of a commentary on the German Basic Law .
