Eduard Müller (Reich judge)

Karl Eduard Mauritius Müller (born September 22, 1854 in Herrischried , † September 4, 1908 in Leipzig ) was a German judge .

Life

He studied law in Freiburg and Strasbourg. In Freiburg he joined the Corps Suevia Freiburg in 1874 . In 1880 the ruler of Baden was sworn in. In 1884 he came to Triberg as a magistrate and in 1888 to Karlsruhe. In 1890 he was promoted to senior magistrate. In 1891 he was transferred to the district judge in Mosbach and in 1892 to Karlsruhe. In 1896 he was promoted to the higher regional judge in Karlsruhe. In 1900 he came to the Imperial Court. He was active in the Second Civil Senate of the Imperial Court . Müller was the rapporteur in the “Kies” decision (RGZ 54, 98), in which the teaching of positive breach of contract was recognized for the first time and created for a right of withdrawal that was detached from Section 326aF BGB. It is believed that he was close to the free law school.

From 1906 to 1908 he worked with Otto Warneyer to compile the official reference work of the Imperial Court.
