Franz Ernst (lawyer)

Franz Ernst (* 9. August 1891 in Grevenbroich , † 28. August 1972 in Cologne ) was a German lawyer and officer of the Air Force of the Armed Forces in World War II . Most recently he held the rank of general judge.

From 1909 to July 1914, Ernst completed a law degree at the University of Freiburg , where he passed his first state law examination on June 15, 1914. On August 19, 1914, he joined the German Army and served during the First World War, initially as a war volunteer, and later as a department adjutant and orderly officer in the 61st Field Artillery Regiment . On November 17, 1918, he resigned from military service and on November 20, 1918, took up a legal preparatory course in Cologne , where Ernst passed his second state law examination on February 10, 1920. He then worked from the end of March 1923 to September 30, 1924 for a lawyer in Cologne and later as legal advisor and head of the testing center of the Association of Germans Abroad. From January 1925 to mid-March 1926 he was legal advisor at the Mechernich mine in Mechernich .

On March 16, 1926 Ernst entered the civil service and worked as an assessor and district judge in Koblenz until the end of April 1928 . On May 1, 1928, he was promoted to the district judge in Cologne , which he remained until the end of December 1936. On January 1, 1937, Ernst transferred to the Air Force, where he was employed as a probationary judge at the Air Force Court III in Dresden until the end of September . After passing his probationary period, he acted from October 1937 to August 28, 1938 as a judge at the Air Force Higher Court III in Braunschweig .

Following this, he switched to the Reich Court Martial, where he worked as an unskilled worker and later as a judge. He held this position until the end of June 1940. On July 1, Ernst was appointed chief judge and legal advisor at Luftflottenkommando 5 at the Commander North, where he worked until mid-January 1941. Subsequently, he was group leader in the legal department of the Reich Aviation Ministry until mid-April 1942 . On April 15, 1942, he was reassigned to the Reich Court Martial, where he was promoted to Reich War Attorney on October 1, 1942. Here on May 1, 1944, he was appointed judge general as an officer in the special troop services . On May 8, 1945, Ernst was taken prisoner of war, from which he was released in 1947.
