Fritz Ossenbühl

Fritz Ossenbühl (born August 16, 1934 in Duisburg ) is a German legal scholar .

Life

Fritz Ossenbühl studied in Cologne , where he also received his doctorate in 1962 and habilitated in 1968 with a thesis on administrative regulations and the Basic Law . He was a scholarship holder of the German Research Foundation .

From 1970 Ossenbühl taught public law at the Rheinische Friedrich-Wilhelms-Universität Bonn . Until his retirement in 1999, he was director of the Constitutional Law Department of the Institute for Public Law.

Since his retirement in 1999 he worked as a lawyer .

His areas of work are constitutional law , municipal law and environmental law including energy and nuclear law . He is the author of a large textbook on state liability law .

When the nuclear phase-out was discussed in Germany , he dealt critically with its legality from a constitutional and administrative point of view. He took a position on the side of the power plant operator. Ossenbühl came to the conclusion that a statutory decommissioning order for nuclear power plants was not a content and limitation of property , but an expropriation of the power plant operator , which would have to be compensated according to the current value of the respective plant . Since expropriation is only permissible for the common good, “there are likely to be considerable problems with justification. That does not mean that the exit would basically be blocked, but only that it cannot happen in the temporal dimension that some imagine, ”he summarized an expert opinion.

Another research focus of Ossenbühl's since his habilitation thesis was the doctrine of legal sources , which he edited extensively in the textbook on general administrative law by Erichsen / Martens and in the manual of constitutional law of the Federal Republic of Germany by Isensee / Kirchhof , most recently in volume V in the 2007 edition.

Ossenbühl is co-editor of the specialist journals Der Staat , Die Public Administration and Verwaltungsrundschau.

Fritz Ossenbühl has been a full member of the North Rhine-Westphalian Academy of Sciences and Arts since 1999 .
