Fritz Smoschewer

Fritz Smoschewer (born May 23, 1894 in Posen , † December 1944 in Auschwitz ) was a German lawyer and specialist in copyright law .

Life

Smoschewer studied law in Munich , Berlin , Bonn and Kiel . After the first legal state examination (Kiel, 1917) followed 1918 Promotion to Dr. jur. at the University of Greifswald . He passed the second state examination in 1921.

After completing his legal training, Smoschewer embarked on a career in justice. He initially worked as a court assessor and magistrate; from 1928 he was a district judge in Berlin. In 1933 he was given a forced leave of absence under the Nazi regime. A professional ban followed. Smoschewer stayed in Berlin with his fiancee, a niece of Victor Klemperer . On July 12, 1944, he was deported to Auschwitz, where he was murdered in December 1944. Since 2018, a stumbling block in Berlin has been remembering the life and murder of Fritz Smoschewer.

The legal significance of Smoschewers is based on his work on copyright in the Weimar Republic . In an appraisal of his writings from today's perspective, it is stated that Smoschewer's copyright ideas were taken up on a national level during the 1965 copyright reform. At the international level, his views on moral law and his comparative law overviews have been received in US law and other legal systems since the 1950s.
