Gerd Niebaum

Gerd Heinrich Niebaum (born October 23, 1948 in Lünen-Brambauer ) is a trained lawyer and former lawyer and notary . From June 29, 1986 to November 14, 2004, Niebaum was President and Chairman of the Board of Management of Borussia Dortmund , and until February 9, 2005 he was also Chairman of the Board of Management of Borussia Dortmund KGaA .

Life

Niebaum is the son of the technical director of the Minister Achenbach colliery in Lünen-Brambauer. He graduated from high school in Dortmund in 1967. Niebaum then studied law in Münster . In 1976 he received his doctorate there with a dissertation on the subject of “ The tortious liability for the activities of others' will: e. Under especially with a view to d. Range d. Responsibility for legal and Infringements of legal interests within the meaning of § 823 I BGB ". He then also worked as a trainee lawyer in Münster. In 1977 Niebaum switched to a law firm in Dortmund. The following year he opened his own law firm specializing in business law.

President of the Borussia Dortmund Association

On October 23, 1984, Niebaum became vice-president of the BVB's emergency board, which, led by Reinhard Rauball , was appointed by the Dortmund district court due to the club's economic hardship . The reason for this emergency board was the avoidance of an election in a divided club. On June 29, 1986, he became president of BVB, when the club faced bankruptcy again economically and on the verge of relegation from the Bundesliga and could only save itself in relegation . Under Niebaum's presidency, Borussia Dortmund then won the DFB Cup in 1989, three German championships (1995, 1996 and 2002), the 1997 Champions League and the 1997 World Cup . In 1996, he was awarded the Citizenship of the Ruhr Area by the Verein pro Ruhrgebiet . As early as 1989, according to his own statement, Niebaum considered resigning from office due to excessive workload, so that he hired Michael Meier, who was successful in Leverkusen, as manager.

With the lack of further sporting successes around the year 2000 and through wrong entrepreneurial decisions in the course of the stadium expansion, BVB under Niebaum's leadership accumulated debts of 98 million euros. Because of these debts, even the club's license for the top division was endangered. The management under Niebaum therefore considered bringing the association to the stock exchange through a specially founded KGaA and generating liquid funds. The IPO in October 2000 then generated around 143 million euros, half of which had to be paid for liabilities. On November 14, 2004, Niebaum resigned as club president of BVB after the KGaA had to admit debts totaling over 120 million euros. He was succeeded by Reinhard Rauball , who had also been his predecessor in this office.

As a result of the financial misery, Niebaum also resigned as chairman of the KGaA on February 9, 2005. According to this announcement, the football club's share also rose briefly, at its peak by eight percent to 2.86 euros, with an issue price in 2000 of 11 euros, but later fell further and in April 2009 was even briefly listed below 1.00 euros .

Legal activity

Niebaum then worked again exclusively as a lawyer and initially also as a notary for his law firm. As early as January 31, 2011, Niebaum returned his license to practice as a notary in order to forestall an impending dismissal. In the first instance, Niebaum lost his license to practice as a lawyer on May 27, 2011 on the grounds of "assumed financial collapse ". Just one month later, Niebaum lost to the landlord of his office property on B1 before the Hamm Higher Regional Court and was sentenced to pay the rent and ancillary costs of more than 750,000 euros until the contractual end of the rental period. In addition, on August 12, 2011, Niebaum suffered another judicial defeat. The Sparkasse Werl demanded payment of the debts of the law firm's account and won the process by 65,000 euros.

On February 6, 2012, the Federal Court of Justice in Niebaum confirmed the withdrawal of the license to practice law due to financial loss. In these years Niebaum is said to have had up to 17.3 million liabilities. A re-admission to the legal profession is basically possible at any time, provided that the admission according to § 6 BRAO is applied for and there are no grounds for refusal according to § 7 BRAO.

On February 13, 2015, Niebaum was sentenced by the Dortmund Regional Court to imprisonment of 20 months on probation for breach of trust, credit fraud, fraud in two cases and forgery of documents. As a condition of probation, Niebaum has to work 50 hours of community service. Incidentally, four months of the sentence were already enforced due to the long duration of the proceedings. Among other things, he had confessed to having paid himself 450,000 euros as an executor as a loan.
