Gerhard Schäfer (judge)

Gerhard Schäfer (born October 18, 1937 in Stuttgart ) was a judge at the Federal Court of Justice from 1989 to 2002 .

After completing his legal training in 1965, Schäfer first settled as a lawyer before joining the judicial service of the state of Baden-Württemberg in 1967 . In 1968 he was appointed district court advisor and in 1972 district court advisor at the Stuttgart district court . In October 1974 he was appointed presiding judge at the regional court.

After his appeal to the Federal Court of Justice in 1989, Schäfer was first a member of the 2nd Criminal Senate and, for a short time, also the 3rd Criminal Senate , before the Presidium assigned him to the 5th Criminal Senate in 1991 , which at that time still resided in Berlin. He was to be a member of the 5th Criminal Senate until 1996, most recently as a member of the Grand Senate for Criminal Matters . From 1993 Schäfer was also deputy chairman of the Senate for auditing matters and of the Senate for tax consultant and tax agent matters. In August 1996 Schäfer was appointed presiding judge at the Federal Court of Justice and took over the chairmanship of the 1st criminal senate .

In 2006, a report was carried out by Schäfer as an expert on the Parliamentary Control Committee in accordance with Section 2c PKGrG prepared for the news of the spying of journalists by the Federal Intelligence Service . On May 30, 2008, Deutsche Telekom AG announced that Schäfer had been commissioned as an expert to investigate the facts of the matter in order to clarify the Telekom spying affair .

In 2011, Schäfer was the head of the investigative commission that examined the work of the Office for the Protection of the Constitution and the police authorities in the context of the murders and terrorist attacks by the right-wing extremist NSU .

Schäfer is the author of numerous legal publications; Among other things, he comments on §§ 94 to 111p of the German Code of Criminal Procedure with the investigative measures in the StPO-Großkommentar Löwe-Rosenberg and is the managing editor of the journal Juristische Rundschau .

He is a member of the fraternity A. V. Virtembergia Tübingen .
