Hemp beer is a name for different types of beer made from components of the hemp plant .

history

The hops used almost exclusively for beer today are part of the hemp family (Cannabaceae), of which several species, including the hemp plant, were used for brewing beer from an early age. Historically, beer was prepared with various additions, in addition to hops and hemp, also with the leaves of the Gagelstrauch , yarrow , gruit and others. The cultivation of hops started around the 8th century. With the work of Hildegard von Bingen (1098–1179), the knowledge about the preservative effect of hops found widespread use (an exclusion of hemp as a possible intoxicant for religious reasons could have played a part) so that all other common additions were strong over the course of several centuries were pushed back. As a clear direction, away from hemp and towards hops, the German Purity Law (exclusively with hops, malt and water as raw materials for beer) of 1516 marks the preliminary complete change, even if it was actually only a decree and not a law, and should rather prevent the wheat for bread from becoming scarce, while barley farmers ( barley for barley malt) lost sales.

100 years ago, the old tradition of hemp beer briefly revived until the opium laws and other bans made hemp illegal in the 1920s. On March 17, 1996, the German federal government changed the cannabis laws to allow the use of the hemp plant subsidized by the EU.

At the end of summer 1996, the Wädenswiler brewery Wädi-Brau-Huus produced the first Swiss hemp beer. The demand was so strong that other breweries were involved in the production. In the following year the hemp beer turn was also brewed in Germany .

Legal

Germany

According to Section 9 of the German Beer Act, hemp beer produced in Germany may not be sold as beer in Germany. When manufactured and distributed in Germany, only mixed beer beverages may be designated as hemp beer . Although z. B. the Berlin beer company brewed its turn using the same procedure as conventional beers and beer tax was paid for this, turn had to be brewed in Switzerland until 2012 after a complaint by the brewers' association before the administrative court.

Since then, other German courts have also been concerned with the question of whether the German Purity Law or the freedom of trade should be valued higher. The Rudolf choice KG from Gundelfingen on the Danube was the production and marketing of alcoholic hemp Trunkes by Bavaria Cannabia never prohibited. Rather, the courts dealt again with the same question; Matthias Schillo, the same lawyer who defended the Bier Company against the Brewers' Association, helped again; with the result that the negotiation had to be stopped.

Meanwhile, "the guardians of the purity law" accept the hemp-beer drinks Cannabia and Cannabis Club Sud brewed in Germany today .

United States

The American Federal Drug Police, DEA, wanted to classify foods containing hemp as marijuana in the early 2000s . Hemp beer that is flavored with industrial hemp with less than 0.3% THC is said to be illegal. An injunction against the entry into force of the September 9, 2001 regulation was issued by the Ninth Circuit's US Court of Appeals on March 7, 2002.
