Heinz Püschel

Heinz Püschel (born December 3, 1919 in Leipzig , † February 18, 2010 in Potsdam ) was a German legal scholar in the field of copyright law .

Life

Püschel was with the work "library photocopy and Copyright" at the 1949 Leipzig University doctorate . The two reviewers for the dissertation were Hans Otto de Boor and Arthur Philipp Nikisch . He completed his habilitation in 1965 at the Humboldt University in Berlin with a thesis on basic questions of a law on copyright in the German Democratic Republic .

In 1964, Püschel was appointed lecturer in the field of copyright law at the Humboldt University in Berlin , and in 1965 he was appointed professor with a teaching assignment for copyright law. Before that he was employed as a research assistant in the Ministry of Justice .

Püschel was considered the doyen of copyright law in the GDR . In addition to participating in various author collectives , he was the editor and author of many publications on the subject. His main theoretical achievement was the postulation of a "socialist personality right" through which he attempted to establish a copyright law to the exclusion of any considerations of property law .

At least in his early works, Püschel denied the possibility of a conflict of interest between author and society, since their interests would cancel each other out in a socialist society. By 1989 at the latest, however, he relativized this attitude. He developed Püschel's main thesis on “socialist personality rights” in detail in his habilitation in 1965 and published it in West German journals such as GRUR and UFITA .

Püschel was a member of the legislative commissions for drafting the new copyright law of the GDR (1965) and the civil code of the GDR (1975) and was head of the working group on the Code of Civil Procedure (ZPO) of the GDR. He was a member of the German Institute for Law and the editorial collective of the legal-theoretical journal State and Law .

Püschel's grave is located in the south-west cemetery Stahnsdorf .
