Hermann Garhofer (born November 1, 1887 in Hainburg an der Donau , † October 3, 1949 in Linz ) was an Upper Austrian judge and politician. In 1945 he was a member of the Eigl state government , a government of civil servants.

Life

Garhofer completed after the conclusion of the Humanistic Gymnasium in Linz with the Matura studying law at the University of Vienna . He worked as a district judge in the district of the regional and higher regional court Linz and was subsequently appointed to the higher regional judge. As a civil servant, he was a member of the Upper Austrian provincial government after the Second World War, where he was responsible for the justice department between May 17, 1945 and October 25, 1945. He was also provisional head of the Linz Higher Regional Court from July 14, 1945 to October 25, 1945. Garhofer was arrested by the United States Army Criminal Investigation Command on November 3, 1945, a few days after the government was dissolved . The arrest was made after Garhofer allegedly refused to dismiss two or three officials of the Higher Regional Court, whereby when checking the judicial staff he only emphasized the professional suitability and the "good character" of the employees, while he - also " illegal “- memberships in the NSDAP had disregarded. Garhofer was released just three days after his arrest, but the US authorities did not approve his return to the judiciary until March 1946.
