Hugo Berger (lawyer)

Hugo Berger (born September 24, 1897 in Domslau (today Domasław ), district of Breslau , † March 13, 1990 in Wiesbaden ) was a German judge at the Federal Labor Court and judge of the Federal Constitutional Court .

In 1941 Berger was appointed higher regional judge at the Higher Regional Court in Katowice in occupied Poland. Expelled from his Silesian homeland, he was a higher regional judge in Frankfurt am Main in 1946 and then in 1949 a ministerial advisor in the Hessian Ministry of Justice. In April 1954 he was appointed judge at the Federal Labor Court. On January 8, 1959, he was elected by the Federal Council for eight years and succeeded Franz Wessel as constitutional judge .

At the First Senate of the Federal Constitutional Court, Berger dealt in particular with questions that are put to the constitutional judiciary in the field of labor and social law. He played a key role in the decision of May 17, 1961, which approved the privatization of the Volkswagen factory under constitutional aspects ( BVerfGE ).

Berger resigned from the Federal Constitutional Court on August 11, 1967. He was succeeded by the later President of the Federal Constitutional Court, Wolfgang Zeidler .
