Jacob Maarten van Bemmelen (born April 20, 1898 in The Hague , † January 12, 1982 in Dordrecht ) was a Dutch legal scholar.

Life

Jan Maarten was the son of the Groningen biology professor Johan Frans van Bemmelen (born December 26, 1859 in Groningen; † August 6, 1956 in Leiden) and his wife Adriana Jacoba Paulus (born June 27, 1873 in The Hague; † March 19, 1945 in Leiden). He was thus a grandson of the famous Leiden chemist Jacob Maarten van Bemmelen . After attending the schools in The Hague and Groningen, as well as the grammar school in Groningen , he completed his military service in 1917 and moved to the University of Groningen in 1919 to study law. On June 27, 1922, he was there Master of Law and received his doctorate on November 3, 1923 on the subject of Van zedelijke verbetering tot reclasseering. In the same year of his doctorate he became a teacher of political science at the high school in Groningen, worked as a lawyer in Rotterdam from 1924 and became deputy judge at the cantonal court in Rotterdam in 1926. In January 1928 he moved as a deputy judge at the city court there and became secretary of the Dutch Genootschap tot zedelike verbetering der gevendet (German: Society for the moral improvement of prisoners ) in Rotterdam. In 1929 van Bemmelen represented the sick Anthony Johannes Blok as a lecturer in criminal law at the University of Leiden , was appointed professor of criminal law, criminal procedural law and criminology there on April 7, 1931, and took up this position on October 2, 1931 with the inaugural speech De beteekenis van het strafrecht voor den normal Mensch (German: The meaning of criminal law for normal people ). During his university teaching phase, he became editor of the legal journal Tijdschrift voor Strafrecht in 1931, editor of the legal journal Weekblad van het Recht in 1933 and editor of the legal journal Nederlandsch Juristenblad in 1936 .

He wrote textbooks on criminal science (1942), criminal law (1954) and criminal procedure law (1936–1957). He was also a member of the Leiden City Council from 1939 to 1940, and in 1940 initiated the Institute for the Promotion of Criminal Law and Criminology. Van Bemmelen was also active in the field of Dutch military law. In 1936 he became co-founder and chairman of Vereeniging voor Miltair Recht (German: Association for Military Law ), in 1940 President of the War Council in The Hague and from 1946 to 1955 he was a member of the editorial team of the legal journal Militair-Rechtelijk Tijdschrift (German: Military Law Journal ). During the phase of the German occupation of the Netherlands (1940/45) by the Germans during World War II , van Bemmelen resigned from his professorship on May 30, 1942 due to the German measures against his Jewish colleagues, such as Eduard Maurits Meijers and Martin David was deported as a hostage to the Sint-Michielsgestel prison camp from August 1942 to June 1943 . He then worked as a lawyer in Leiden and regained his professorship on September 4, 1945 after the liberation of the Netherlands.

In the academy year 1953/54 he became rector of the Alma Mater , for which he gave the rector's speech Universiteit en Strafrecht (German: University and Criminal Law ) on February 8, 1954, on the 379th anniversary of the existence of the Leiden University , and in this capacity awarded Peter Johannes Waardenburg , Jean Schlumberger , Edward Morgan Forster , Victor Emanuel van Vriesland (1892–1972) received honorary doctorates from the University of Leiden. Van Bemmelen also worked abroad in the Netherlands. He became Vice President of the International Association of Penal Law, the International Society of Criminology, and advocated the approximation of the criminal justice systems of the Netherlands with that of Belgium and Luxembourg. For his services to the Dutch legal system, he received the knighthood of the Order of the Dutch Lion , the Dutch Mobilizing War Cross , was commander of the Belgian Order of the Crown , Commander of the Luxembourg Order of the Oak Crown , Knight of the French Order of Health Merit and Knight of the French Order of Education des Palmes Académiques . On September 1, 1968, he retired from his professorship and spent his last lifetime with his family in Dordrecht, where he finally died.

Van Bemmelen married on July 12, 1922 in Zuidorn with Clara Adriana Petronella Kluit (born April 12, 1898 in Rotterdam), the daughter Gerhard Oswald Kluit and Petronella Hester Elisabeth Kruijt. There are four sons from the marriage. After his divorce on May 13, 1966, he married Johanna Maria Leenders on May 23, 1966 in Leiden (* around 1915 † March 24, 1990 in Dordrecht). The marriage remained childless. We know of the children of the first marriage:
