Maina Kiai, 2013

Maina Kiai is a Kenyan lawyer and human rights activist . As of May 1, 2011, he was the United Nations Special Rapporteur on Freedom of Assembly and Organization . His second and final term ended on April 30, 2017.

Kiai campaigned for human rights in Kenya , focusing on fighting corruption and supporting political reform. He also fought against impunity following the 2007/2008 riots in Kenya that plunged Kenya into crisis in 2008. He is currently a co-director of the Kenyan non-governmental organization InformAction , a human rights organization .

Education and career

Kiai is a lawyer trained in Nairobi and Harvard University . Maina Kiai's human rights work began in 1992 when he co-founded the unofficial Kenya Human Rights Commission. Kiai served as Director of the Commission until September 1998. Kiai next became director of Amnesty International's Africa program (1999-2001) and Africa director of the International Rights Group for Human Rights, (now called Global Rights, 2001-2003), before eventually serving as chairman for the period 2003-2008 the National Human Rights Commission in Kenya. From July 2010 to April 2011, Kiai was director of the International Council on Human Rights Policy. He had also received research grants at the Danish Institute for Human Rights, the Woodrow Wilson International Center for Scholars and the TransAfrica Forum.

Kiai currently serves as the director of the local Kenyan non-governmental organization InformAction , which uses a multimedia approach, mainly video productions, to educate Kenyans about their human rights. Kiai writes a regular column for the Daily Nation , Kenya's largest independent newspaper.

Prizes and awards

In 2014, Freedom House awarded Kiai the Freedom Prize, which was initiated in 1943 to “honor the recipients for their invaluable contribution to freedom and democracy”. Previous winners include a. Chen Guangcheng , Aung San Suu Kyi , Václav Havel , the 14th Dalai Lama , Medgar Evers, and Edward R. Murrow .

In October 2016, Kiai was awarded the United Nations Foundation's Leo Nevas Prize for his work as Special Rapporteur. This award recognizes "those who have served as agents of change in promoting international human rights". In December 2016, he received the AFL-CIO (American Federation of Labor and Congress of Industrial Organizations) George Meany Lane Kirkland Human Rights Award 2016 for his “commitment and effectiveness in highlighting the widespread denial of basic human rights at work and in the world Society".

Work as special rapporteur

Maina Kiai assumed his duties as the first special rapporteur on freedom of assembly and organization on May 1, 2011 . He ended his second and final term on April 30, 2017, and was succeeded by Annalisa Ciampi from Italy. Special Rapporteurs are independent of any government or organization.

As Special Rapporteur, Kiai has submitted or co-authored seven reports to the Human Rights Council. It was about the following topics:

  • Best Practice in Promoting Freedom of Assembly and Association (May 2012)
  • Civil society's ability to access funding and resources (April 2013)
  • The plight of "most vulnerable" groups in exercising their rights of assembly and association (June 2014)
  • Rights to peaceful assembly and association in connection with the exploitation of natural resources (June 2015)
  • Joint report with recommendations for the effective administration of meetings (March 2016), with the special rapporteur Christof Heyns .
  • Impact of Fundamentalism on the Rights of Assembly and Association (June 2016)
  • Imagine a world without participation. Illustration of the achievements of civil society (June 2017 - presented by successor Annalisa Ciampi)

Kiai wrote four reports to the UN General Assembly on the following topics:

  • Rights to peaceful assembly and association in the context of the elections (October 2013)
  • The impact multilateral institutions have on the promotion and protection of the rights of assembly and association (October 2014)
  • Comparing how companies and associations treat countries and why companies tend to receive more favorable treatment (October 2015)
  • Difficulties Facing Marginalized Workers Around The World In Exercising Their Right Of Assembly And Association In The Workplace (October 2016)

Kiai officially visited nine countries: Georgia (2012), Great Britain (2013 and 2016), Rwanda (January 2014), Oman (September 2014), Kazakhstan (January 2015), Chile (September 2015), the Republic of Korea (January 2016) ) and the United States of America (July 2016).

As a special rapporteur, Kiai issued more than 190 press releases via UNHCHR and sent over 900 notices to member states of the United Nations .

Kiai traveled to the United States in July 2016. This was the first official country visit made by a UN special rapporteur on the rights to peaceful assembly and association.

Retaliation for human rights work

Maina Kiai has been threatened and harassed several times because of his human rights work. He last reported in September 2013 that thugs had come into his mother's shop in Nyeri and threatened to burn it down. In 2008, Kiai was one of several human rights defenders to receive death threats when post-election violence raged in Kenya. A coalition of Kenyan civil society groups reported that they had learned of a conspiracy in which "an elite troop of five or more men had been commissioned with the removal, including by Maina Kiai."
