Marcus Koehler

Marcus Köhler (born January 5, 1967 in Coburg ) is a German lawyer and has been a judge at the 5th Criminal Senate of the Federal Court of Justice since 2018 .

Life

Koehler grew up in Franconia Mitwitz , the son of the later years of the district administrator of the district Kronach , Heinz Köhler on. After attending the elementary school in Mitwitz, Köhler went to the Kronacher Frankenwald-Gymnasium, where he passed the Abitur in 1986. He then completed his alternative military service as a community service member at the Kronach district association of the Bavarian Red Cross . Köhler studied law at the Friedrich-Alexander University in Erlangen and passed the first state examination. After successfully passing the second state examination, Köhler entered the higher judicial service of the Free State of Saxony with effect from October 1, 1998 and worked as a judge at the Leipzig District and Regional Court . In 2001 he left the judicial service at his own request and worked as a lawyer until mid-2002.

With effect from July 1, 2002 Köhler entered the higher judicial service, now in the state of Hesse . There he was initially employed by the public prosecutor in Kassel , where he was also appointed public prosecutor for life in June 2004. From January 2005 to mid-April 2007 there was a secondment to the General Public Prosecutor's Office in Frankfurt am Main . During this period of activity, Köhler represented the prosecution in the case of the cannibal von Rotenburg .

Following his work in Frankfurt, Köhler was seconded to the federal prosecutor's office as a research assistant . There he was appointed public prosecutor at the BGH in March 2011. Linked to this was the official transfer to the Federal Court of Justice. There Köhler initially worked in the terrorism department. In addition, from May 2011 he was appointed head of the public prosecutor's office, which he held until 2014. The so-called NSU trial was opened at this time . On June 10, 2013, he was promoted to senior public prosecutor at the BGH.

From March 2015 Köhler was seconded to the Federal Ministry of Justice and Consumer Protection . There he played a leading role in the draft law on the criminal asset recovery. The judges' selection committee of the Federal Ministry of Justice and Consumer Protection elected 12 new judges for the Federal Court of Justice on March 9, 2017, including Köhler. The appointment was made on February 13, 2018 by Federal President Frank-Walter Steinmeier . Köhler was assigned to the 5th Criminal Senate based in Leipzig .

He has been involved in the Meyer-Goßner / Schmitt work: Code of Criminal Procedure since the 61st edition .
