Oksana Makar

Coordinates: 46 ° 58 ′  N , 31 ° 59 ′  E Oksana Makar (born June 11, 1993 ; † March 29, 2012 in Mykolaiv ) wasraped, strangled,at the age of 18 on March 8, 2012 in Mykolaiv ( Ukraine ), lit and left to die. She died three weeks later. Her fate became a case of notoriety when only one of the perpetrators was accused by the police. The other two, whose parents were reportedly former government officials, were released on police bail allegedly because of their parents' personal relationships. They were later arrested again after public outcry and mass protests on March 13, 2012. Protests for a fair judgment, fundraising and blood donation for the victim continued after the arrest.

Persons involved in the case

Oksana Makar

Oksana Serhiyivna Makar spent much of her childhood in an orphanage after both her father and stepfather were arrested for drug trafficking and her mother was convicted of robbery and sentenced to three years in prison. She only attended school for six years, ran away from the orphanage and lived on her own in various places, abandoned by her parents, and began with petty theft and prostitution from the age of 11. This later led to problems with their employability in work.

Evgeny Krasnochek

Evgeny Krasnochek (main suspect) left home at 17 and worked in various unsightly jobs. He lived in a dormitory with his wife and one year old daughter. Krasnochek has remained under police arrest since his arrest on March 11.

Maksim Prisyazhnikov

Maksim Prisyazhnikov worked as a lawyer in the Cultural Department of the Mykolaiv City Council. His adoptive mother was the head of the Yelanets District Council before she retired in 2009. (Note: Еланець / Yelanets is 20 kilometers north of Mykolaiv.) Prisyazhnyuk was arrested on March 11, 2012, released on bail and arrested again after public protests. Prisyazhnyuk was a member of the Party of Regions youth organization , but was expelled from its ranks in 2010. Prisyazhnyuk then continued his political career as a member of the United Center , but - according to this party - had never been a member and had only volunteered for it during the 2010 local elections in Ukraine .

Artem Pogosyan

It was initially reported that Artem Pogosyan's father previously worked as a senior civil servant in the Mykolaiv District Attorney's office. According to police reports, his father worked as a manual laborer and died in January 2012; his mother is a librarian. Pogasyan was arrested on March 11, 2012, released on police bail, and later arrested again due to public protests.

The raid

Makar was allegedly on the night of 8./9. Attacked by three men in Mykolaiv, southern Ukraine on March 3, 2012. There are conflicting statements about the details of how the suspect and the victim met and what happened on the night of the murder, but it is undisputed that she met at least two of her attackers in the pub called "Rybka" in Mykolaiv and they in together went to an apartment that belonged to one of the alleged attackers. It has been alleged that Prisyazhnyuk already knew Makar before they met on March 8 and planned the crime, although Makar's mother denied it. Three men raped Makar in the apartment and tried to strangle her with a cord. They then took Makar, who was barely conscious, to a nearby construction site, wrapped her in a sheet, and set her on fire, the fire burning all night. She was discovered the next morning, still conscious, by a passing motorcyclist and taken to a hospital. Fifty-five percent of her body was burned, and there was also lung damage from smoke inhalation.

Medical measures and death

Makar was transferred to the Donetsk Burn Center , a modern medical institution with an international reputation, where a Swiss surgeon operated on her. Her right arm and both feet had to be amputated to stop the bones from eating.

Makar died on March 29, 2012 as a result of her injuries. She was buried on March 30th in Luch. Since she died unmarried, she was buried in a wedding dress according to local Ukrainian traditions .

Investigation and trial

Three men - Evgeny Krasnochek, 23, Maksim Prisyazhnikov, 24 and Artem Pogosyan, 22 - were arrested on March 11, 2012, but Prisyazhnyuk and Pogasyan were released on police bail. Shortly thereafter, the media claimed that Prisyazhnyuk and Pogasyan's parents were former government officials from the Mykolaiv area and connected with local politicians. It was reported that Prisyazhnyuk was the adopted son of a former head of the district council, and Pogasyan was the son of the regional prosecutor. In their statement, the police confirmed the allegations regarding Prisyazhnyuk, but found that Pogasyan's mother was a librarian and that his father was a manual laborer before he died in January 2012. After protests on the streets of Mykolaiv and other cities against the police bail for Prisyazhnyuk and Pogasyan, Ukrainian President Viktor Yanukovych intervened and an investigation team from Kiev , the capital of Ukraine, came to Mykolaiv. The two suspects, who were released on bail, were arrested again and at least four local law enforcement officers were released.

On March 29, 2012, a spokesman for the Ministry of Interior announced that all three men would face life sentences for the rape and murder of Oksana Makar.

The public trial of this criminal case began on May 24, 2012 at the Mykolaiv Central District Court ( Mykolaiv Raion ). "As mentioned above, the presiding judge excluded the public from the trial after the first day of the trial without giving any reasons, and one of the defendants also stayed away from the first day of the trial without giving any reasons."

Judgment of November 27, 2012

According to the Berliner Tageszeitung, the perpetrators were sentenced to the following sentences:

  • Yevhen Krasnoschek: life sentence
  • Maksym Prisyazhnyuk: 15 years
  • Artem Pogosyan: 14 years

However, the victim's mother's lawyers are appealing to obtain a higher sentence for Prisyazhnyuk and Pogosyan.

Public reactions

The police's actions were heavily criticized by the media and resulted in public protests in Mykolaiv, Kharkiv , Lviv and Odessa . Makar's death has been linked to so-called " high animal crimes" committed either by the children of public officials or by the officials themselves. According to Tatiana Surovitskaya, the victim's mother, her contacts within one of the major TV channels in Ukraine helped her ensure widespread initial media coverage. Surovitskaya posted footage of Makar at the hospital on YouTube after medics were forced to amputate her arm and both feet two weeks after the attack (these amputations can be clearly seen in the video).

The Ukrainian billionaire and member of parliament Rinat Akhmetov (financially) supported the transfer of Makar to the Donetsk Incineration Center and also for the Swiss surgeon.

The governor of Mykolaiv Oblast , Nikolai Kruglow , and others blamed the injured girl's family (see also: “ Rape Myth ”): “The problem of child control is a family matter. It is an underage child, at 18 it should go to school and study better - unfortunately I have to put it that way. ” Rajissa Bohatyrjowa ( Deputy Prime Minister of Ukraine and Minister of Health at the same time ) consulted Nikolai Kruglow and asked him for any medical requirements Providing help for Oksana.

The adviser to the President of Ukraine , Marina Stavniychuk, expressed her support for the residents of Mykolaiv and opposed the suspects' initial release. It announced that the Presidential Administration had been informed of the conduct of law enforcement officials who released those suspected of rape and attempted murder. The presidential adviser also expressed her personal disbelief at the suspects' release.

Serhiy Sobolev, MP, said that "the press secretary of the regional police department is obviously lying" when she (according to Col. Olga Perederenko) stated that "the girl was in such a condition that no evidence can be obtained." Sobolev was shocked that Olga Perederenko still stuck to her position.

During the plenary session of the Parliament of Ukraine on March 14, 2012, in response to the incident with Oksana Makar, Gennady Zadyrko said that Ukraine should "reintroduce the death penalty". MP Oleg Lyashko urged his colleagues to donate the salary one day for medical treatment of Makar. He also expressed the opinion that one should "neuter pedophiles".

The Secretary of the National Security and Defense Council of Ukraine , Andrij Kljujew , expressed his confidence that violators will be punished with the full power of the law. He noted that "the government must respond adequately to any crime - no one can escape punishment, regardless of affiliation or social status."

The Excellent Artist of Ukraine Angelica Rudnitskaya stated they do not believe in executing the command of President Viktor Yanukovych ensure the full and impartial investigation into the rape of Oksana Makar. She said: "If the law enforcement system is unable to protect its citizens and punish those responsible, the people themselves must use every legal means available to force them to do so."

After Makar's death on March 29, 2012, President Yanukovych and Prime Minister Mykola Azarov were among the first to express their condolences. Azarov wrote on his blog “No compromises. Only knowing that punishment is inevitable will these monsters shrink from harming other people's lives and rights ”.

Rallies and fundraising

On the morning of March 13, 2012, dozens of Mykolaiv residents went to the first rally near the Police Headquarters. The rally moved to the office of the Prosecutor of Mykolaiv Province. Another protest rally was held in Lenin Square.

On March 15, 2012, another rally in support of Oksana Makar was held in downtown Mykolaiv near Lenin Square, attended by a few thousand people. Due to the waves that the attack on Oksana Makar made, another similar criminal case was uncovered, in which the same perpetrators after Oksana Makar also raped and abused another teenager, Aleksandra Popova, who was hospitalized on the same day and was passed out for several weeks. The rally supported both Oksana Makar and Aleksandra Popova. The demonstrators who gathered in Lenin Square were able to collect an amount of 7511 hryvnia for the treatment of Oksana Makar and 6652 hryvnia for Alexandra Popova. The general public donated over 1 million hryvnia to treat Makar, according to her mother.

Donating blood

On 14/15 March 2012, more than 150 Mykolaiv citizens donated blood for Oksana Makar. After she was transferred to Donetsk, over 60 Donetsk residents and 150 Donetsk police officers donated blood there.
